Conditions or Reasons for Planning Application - CB/25/00578/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers L-03; L-05; L-04; L-01/ rev G; L-02/ rev F; 24010-1; Ecological Appraisal (Cherryfield Ecology, 14/10/2024); Tree Survey, Arboricultural Impact Assessment and Preliminary Method Statement (Arc Arboricultural Solutions, ref: AAS/0498/ rev 01, 12/11/2024); Biodiversity Net Gain Report (Kenneth Coyne, April 2025); Preliminary Ecological Appraisal (Kenneth Coyne, November 2024)


Reason: To identify the approved plan/s and to avoid doubt.
3) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
4) Notwithstanding the requirements under condition 3, no development shall take place, including any works of demolition, until a Construction Traffic Management Plan, associated with the development of the site, has been submitted and approved in writing by the Local Planning Authority which will include information on:

(A) Loading and unloading of plant and materials used in the development
(B) Storage of plant and materials used in the development
(C) The erection and maintenance of security hoarding / scaffolding affecting the
highway if required.
(D) Wheel washing facilities
(E) Measures on site to control the deposition of dirt / mud on surrounding roads
during the development.
(F) Temporary TRO footpath/footway/cycleway or road closures needed during the
development period
(G) Temporary TRO/traffic management needed during the development period.
(H) The provision of banksmen to manage any larger construction or delivery
vehicles.
(I) Road plates over utility covers
(J) Details of parking for contractor / construction staff parking
(K) A commitment to deliveries outside of peak times

The approved Construction Management Plan associated with the development of the site shall be adhered to throughout the development process.

Reason:

In the interests of safety, protecting the amenity of local land uses, neighbouring residents and highway safety (Policies T2 and HQ1, Central Bedfordshire Local Plan).
5) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
6) Prior to the occupation of any dwelling on the site, a scheme for the provision of waste receptacles for each dwelling shall be submitted to and agreed in writing by the Local Planning Authority. The receptacles shall be provided before occupation takes place.

Reason: In the interest of residential amenity and to reduce waste generation in accordance with the Councils's Minerals and Waste Local Plan 2014, Policy WSP5 and the adopted SPD "Managing Waste in New Developments" (2006).
7) Two dwellings hereby approved, as shown on approved drawing ref: L-01/ rev G, shall be constructed in accordance with the optional requirements of M4 (2) adaptable homes, as defined in the Building Regulations 2010 as amended and Approved Document M (Access to and use of buildings).

Reason: To ensure the provision of adaptable and accessible homes, in accordance with Policy H2 of the Central Bedfordshire Local Plan (2021).
8) No development shall take place (including vegetation/site clearance) until a Precautionary Working Method Statement (PWMS) for amphibians and nesting birds has been submitted to and approved in writing by the Local Planning Authority. The approved PWMS shall be implemented in full according to the specified timescalesd during the course of the construction of the development, unless otherwise agreed in writing by the local planning authority.

Reason: This is a pre-commencement condition to ensure development is ecologically sensitive and secures biodiversity enhancements in accordance with the National Planning Policy Framework (Section 15).
9) The development hereby approved shall be carried out in strict accordance with all ecological measures and/or works within the details contained in the October 2024 Ecological Appraisal as already submitted with the planning application and agreed in principle with the local planning authority prior to determination (or any equivalent document submitted to include updated survey results).

Reason: To ensure that works are ecologically sensitive and do not result in adverse impacts to protected species. (Section 15 of the NPPF)
10) The development shall not commence until a Habitat Management and Monitoring Plan (the HMMP), prepared in accordance with the approved Biodiversity Gain Plan and including:

(a) a non-technical summary;
(b) the roles and responsibilities of the people or organisation(s) delivering the [HMMP];
(c) the planned habitat creation and enhancement works to create or improve habitat to achieve the biodiversity net gain in accordance with the approved Biodiversity Gain Plan;
(d) the management measures to maintain habitat in accordance with the approved Biodiversity Gain Plan for a period of 30 years from the completion of development; and
(e) the monitoring methodology and frequency in respect of the created or enhanced habitat to be submitted to the local planning authority;

has been submitted to, and approved in writing by, the Local Planning Authority. The development shall be implemented in full accordance with the approved HMMP prior to first occupation of the dwellings hereby approved.

Reason: This is a pre-commencement condition to ensure the provision and maintenance of BNG in accordance with paragraph 9 of Schedule 7A of the Town and Country Planning Act 1990 and Policy EE2 of the Local Plan.
11) No development shall take place until details of the existing and final ground and slab levels and finished ridge heights, of the buildings hereby approved have been submitted to and approved in writing by the Local Planning Authority. Such details shall include sections through both the site and the adjoining properties to the north, east and south (the location of which shall first be agreed in writing with the Local Planning Authority). Thereafter the site shall be developed in full accordance with the approved details.

Reason: To ensure that an acceptable relationship results between the new development and adjacent buildings and public areas.

12) All external works hereby permitted shall be carried out in materials in accordance with the schedule of materials as shown on approved drawing refs: L-03, L-04 and L-05 and as stated in the submitted application form.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match the existing building in the interests of the visual amenities of the locality.

13) Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 2015, or any amendments thereto, the garage accommodation on the site and parking provision shall not be used for any purpose, other than as garage accommodation, parking provision unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason

To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users (Policies T2 and T3, Central Bedfordshire Local Plan, 2021)
14) No building shall be occupied until the widened junction of the proposed vehicular access with the highway has been constructed in accordance with the approved details and any existing surplus lengths of as part of the junction not incorporated in the access hereby approved shall be closed in a manner to the Local Planning Authority's written approval and constructed in accordance with the approved details.

Reason

In order to minimise danger, obstruction and inconvenience to users of the highway and the premises (Policies T2 and T3, Central Bedfordshire Local Plan, 2025)
15) Prior to first occupation of the dwellings hereby approved, a scheme for the secure and covered parking of cycles on the site (including the internal dimensions of the cycle parking area, stands/brackets to be used and access thereto), calculated at one cycle parking space per bedroom shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be fully implemented before the development is first occupied or brought into use and thereafter retained for this purpose.

Reason

To ensure the provision of adequate cycle parking to meet the needs of occupiers of the proposed development in the interests of encouraging the use of sustainable modes of transport (Policies T2 and T3, Central Bedfordshire Local Plan, 2021)
16) The refuse collection scheme, as shown on approved drawing ref: L-01/ rev G, shall be fully implemented prior to occupation of any dwelling and shall be retained thereafter.

Reason

In the interest of amenity and in order to minimise danger, obstruction and inconvenience to users of the highway and the premises (Policy T2, Central Bedfordshire Local Plan, 2021)
17) Prior to the first occupation of the dwelling hereby approved, full details of the electric charging point as shown on drawing ref: L-06/ rev A, including details of equipment design and colour, shall be submitted to and approved in writing by the local planning authority. The approved details shall be implemented, with the charging point available for use prior to occupation.

Reason: To ensure that adequate parking with facilities for the charging of electric vehicles are provided in accordance with Policies HQ1, T5, T3, T2, CC1 of the Central
Bedfordshire Local Plan and the NPPF.
18) Prior to first occupation of the dwelling hereby approved, a scheme shall be submitted for approval in writing by the Local Planning Authority indicating the positions, design, materials and type of boundary treatment. The boundary treatment shall meet the standard of a 2m high closed boarded fence (minimum 10 kg/m2) . The approved boundary treatment shall be completed in accordance with the approved scheme before the dwelling is occupied and be thereafter retained.

Reason: To safeguard the appearance of the completed development and the visual amenities of the locality and in the interests of the residential amenities of adjoining occupiers (Section 12, NPPF)
19) Prior to first occupation of the dwelling hereby approved, a landscaping scheme to include all hard and soft landscaping, including replacement native trees and hedgerows, and a scheme for landscape maintenance for a period of five years following the implementation of the landscaping scheme shall be submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping.

20) The dwelling hereby approved must comply with the water efficiency standard of 110 litres per person per day as detailed by Regulation 36(2)(b) of Part G of Schedule 1 and
Regulation 36 to the Building Regulations 2010 (as amended).

Reason: To ensure the efficient use of water in accordance with Policy CC1 of the Central Bedfordshire Local Plan (2021) and the objectives of sustainability set out in the
NPPF (2024).
21) The development hereby approved shall be implemented in full accordance with the Tree Survey, Arboricultural Impact Assessment and Preliminary Method Statement (including Sections 7.0, 8.0 and 9.0) (Arc Arboricultural Solutions, re: AAS/0498/ rev 01, dated 12/11/2024).

Reason

In the interests of the protection of existing trees and hedgerows within the site (Policy EE4, Central Bedfordshire Local Plan, 2021)
22) Notwithstanding the provisions of Part 1, Classes A, AA, B and C of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no extensions to the building, or alterations to the roof, hereby permitted shall be carried out without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the external appearance of the building/s in the interests of the amenities of the area.

23) There shall be no gates within the access unless otherwise agreed in writing by the local planning authority.

Reason

To allow access to all vehicular traffic using the site to the turning area so vehicles can leave in forward gear (Policy T2, Central Bedfordshire Local Plan)
24) Prior to first occupation of the dwellings hereby approved, all on site vehicular areas shall be surfaced in a stable and durable materials in accordance with details to be approved in writing by the Local Planning Authority. Arrangements shall be made for surface water drainage from the vehicular areas of the site to soak away within the site
so that it does not discharge into the highway or into the main drainage system.

Reason

To avoid the carriage of mud or other extraneous material or surface water from the site so as to safeguard the interest of highway safety and reduce the risk of flooding and to
minimise inconvenience to users of the premises and ensure satisfactory parking of vehicles outside highway limits (Policy T2, Central Bedfordshire Local Plan)
25) Details of 'keep clear' visitor and 'keep clear' turning area signage and / or demarcation shall be submitted to and approved in writing by the local planning authority and the approved details shall be implemented prior to first occupation of the approved dwellings and remain thereafter.

Reason

For the avoidance of doubt and to maintain a visitor parking space and turning area within the site (Policy T2, Central Bedfordshire Local Plan)
26) Prior to occupation, the proposed development shall be carried out and completed in all respects in accordance with the access siting and layout, parking layout including visitor parking, garaging, unobstructed turning area and refuse collection point illustrated on the approved plan No. L-01 rev D and defined by this permission and, notwithstanding the provision of the Town and Country Planning General Permitted Development Order 2015, (or any Order revoking or re-enacting that Order) there shall be no variation without the prior approval in writing of the Local Planning Authority.

Reason

To ensure that the development of the site is completed insofar as its various parts are interrelated and dependent one upon another and to provide adequate and appropriate
access arrangements at all times (Policies T2 and T3, Central Bedfordshire Local Plan)
27) All works to or affecting trees on or adjoining the site shall be carried out in accordance with the relevant recommendations of BS3998 2010.

Reason: To safeguard the existing trees on the site in the interests of visual amenity.

28) Prior to development beginning on site, full details of surface water drainage shall be submitted to, and agreed in writing by, the Local Planning Authority. The development shall be implemented in full accordance with the approved details.

Reason

In the interests of suitable surface water drainage within the site (Policy CC5, Central Bedfordshire Council Local Plan, 2021)
