Conditions or Reasons for Planning Application - CB/25/01110/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers; L1B, L2A, L3A, E1A, P1A, P2, P3.

Reason: To identify the approved plan/s and to avoid doubt.
3) Prior to development, full details of a pile and beam foundation, to be used in the construction of the garage, and designed by a suitably qualified structural engineer in association with the Project Arboriculturist, shall be submitted to the Local Planning Authority for approval. The foundation shall be based on the build requirements set out in Section 8.3 "Implementation of the new building on a "raft style" foundation with associated piles/pads" and Section 8.4 "Concrete Mixing" of the supporting document "BS5837 : 2012 Tree Survey and Arboricultural Impact Assessment", dated 31st March 2025 (Document Ref. GHA/DS/162420 : 25) as prepared by GHA Trees. The approved foundation design shall then be constructed in accordance with the working methodology set out in Section 8.3 and Section 8.4.

Reason: To ensure that foundation construction within the designated Root Protection Areas of the Alder tree T3 and Silver Birch Group G7 imposes minimal damage to the rooting system and rooting medium of these trees.
4) Prior to development, a Tree Protection Plan shall be submitted to the Local Planning Authority for approval, showing the positioning of tree protection fencing and/or ground protection, based on the findings set out in Appendix A "Arboricultural Impact Assessment Rev A" dated March 2025 and Appendix B "Tree Table" of the supporting document "BS5837 : 2012 Tree Survey and Arboricultural Impact Assessment", dated 31st March 2025 (Document Ref. GHA/DS/162420 : 25) as prepared by GHA Trees. The approved Tree Protection Plan shall then be implemented prior to the commencement of construction, and shall adhere to the installation requirements set out in Sections 8.1 "Tree Protection Barriers" Section 8.3 "Ground Protection" and Appendix C "Tree Fencing Detail" of this document. The tree protection fencing and/or ground protection shall then remain securely in position throughout the entire course of development works.

Reason: To establish a secure Construction Exclusion Zone around the remaining designated Root Protection Areas of adjacent trees, so as to protect from ancillary development "run-off" activity such as contractor working access, material storage and soil contamination from concrete mixing and washings, which may be incurred during the installation of foundation construction and then from development activity thereafter.
5) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those of the existing outbuilding.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match the existing outbuilding in the interests of the visual amenities of the locality.

6) The building shall only be used for purposes incidental to the enjoyment of the dwelling.

Reason: To prevent the introduction of an inappropriate use harmful to the residential character of the area.
