Conditions or Reasons for Planning Application - CB/25/01236/PAAD
Conditions or Reasons:
1) Class Q of Part 3, Schedule 2 of the Town and Country Planning (General Permitted Development) Order 2015 permits: (a) a change of use of- (i) a building that is part of an established agricultural unit and any land within that building's curtilage, or (ii) a former agricultural building that was (but is no longer) part of an established agricultural unit and any land within that building's curtilage, to a use falling within Class C3 (dwellinghouses) of Schedule 1 to the Use Classes Order. Under Class Q1.b) development is not permitted by Class Q if - in the case of a site that was (but is no longer) part of an established agricultural unit - (iii) since ceasing to be part of an established agricultural unit, the site has been used for any non-agricultural purpose. Insufficient evidence has been presented to demonstrate that the building on site formed part of an established agricultural unit since there is no planning record of the building which appears to have been erected without planning permission or agricultural prior approval. In addition, insufficient evidence has been presented to demonstrate that since ceasing to be part of an established agricultural unit, the building has not been used for any non-agricultural purpose. The proposal therefore fails to meet with the criteria in Q.1(b)(iii) of Part 3, Schedule 2 of the Town and Country Planning (General Permitted Development) Order 2015.
