Conditions or Reasons for Planning Application - CB/25/01263/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers:

Reason: To identify the approved plan/s and to avoid doubt.
3) The premises shall only be open to customers between 12:00 hours and 23:00 hours Mondays to Saturdays, and 12:00 and 22:00 on Sundays and Bank Holidays.

Reason: To safeguard the residential amenity which the occupiers of neighbouring properties might reasonably expect to enjoy.

4) The external sound level emitted from plant, machinery or equipment at the development hereby approved shall not exceed the lowest existing background sound level at the nearest receptor in order to prevent any adverse impact. The assessment shall be made in accordance with BS4142:2014 at the nearest and/or most affected noise sensitive premises, with all machinery operating together at maximum capacity.

Reason: To protect the amenity of nearby residential occupiers.

5) Prior to use, machinery, plant or equipment and the extract/ ventilation system and ducting at the development shall be mounted with proprietary anti-vibration isolators and fan motors shall be vibration isolated from the casing and adequately silenced and maintained as such.

Reason: To protect the amenity of nearby residential occupiers.

6) Odour mitigation should be installed as recommended in the South Midland Ventilation Ltd. Ventilation Report October 2025 (excluding Ducting Layout on page 6) system details, namely filters and ozone injection for treatment of odour. These should be maintained and cleaned as recommended by the manufacturer in order that they are effective in removing odour.
