Conditions or Reasons for Planning Application - CB/25/01380/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers K1709-01E, k1709-02E, K1709-03E, K1709-04B, K1709-05B, K1709-06A, K1709-07

Reason: To identify the approved plan/s and to avoid doubt.
3) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those detailed in the Design and Access Statement:

Off-white render walls
Slate tile roof
Anthracite grey aluminium windows

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match those detailed in the Design and Access Statement in the interests of the visual amenities of the locality.

4) Prior to occupation, an Ecological Enhancement Plan for the creation of new wildlife features such as the inclusion of integrated bird/bat and bee boxes in buildings/structures has been submitted to and approved in writing by the local planning authority.

Reason: To ensure development is ecologically sensitive and secures biodiversity enhancements in accordance with the National Planning Policy Framework (2024)
5) Notwithstanding, The Town and Country Planning (Use Classes) Order 1987 and The Town and Country Planning (General Permitted Development)(England) Order 2015 (or any order revoking and/or re-enacting those orders with or without modification), the dwelling hereby permitted shall be constructed as a self-build dwelling within the definition of self-build and custom housing in the 2015 Self-Build and Custom Housebuilding Act (as amended by the 2016 Housing and Planning Act):

(i) The first occupation of the dwelling in the development shall be by persons who had a primary input into the design and layout of the dwelling.

Reason: To ensure the development complies with the self-build and custom house building definition and help to meet the Councils self-build requirement
6) Prior to the occupation of any dwelling on the site, a scheme for the provision of waste receptacles for each dwelling shall be submitted to and agreed in writing by the Local Planning Authority. The receptacles shall be provided before occupation takes place.

Reason: In the interest of residential amenity and to reduce waste generation in accordance with the Councils's Minerals and Waste Local Plan 2014, Policy WSP5 and the adopted SPD "Managing Waste in New Developments" (2006).
7) The first floor bathroom windows in the north elevation and first floor ensuite window in the south elevation of the development hereby permitted shall be permanently fitted with obscured glass of a type to substantially restrict vision through it at all times and shall be non-opening, unless the parts of the window(s) which can be opened are more than 1.7m above the floor of the room(s) in which the window(s) is installed. No further windows or other openings shall be formed in the north and south elevation.

Reason: To safeguard the privacy of occupiers of adjoining properties

8) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors - November 2023 Update https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
9) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
10) The dwelling hereby approved must comply with the water efficiency standard of 110 litres per person per day as detailed by Regulation 36(2)(b) of Part G of Schedule 1 and Regulation 36 to the Building Regulations 2010 (as amended).

Reason: To ensure the efficient use of water in accordance with Policy CC1 of the CBLP (2021) and the objectives of sustainability set out in the NPPF (2024).
