Conditions or Reasons for Planning Application - CB/25/01408/VOC
Conditions or Reasons:
1) The proposed variation of condition 2 of planning permission CB/24/03301/FULL would materially alter the description of the development and cannot be considered as part of an application made under Section 73 of the Town and Country Planning Act 1990.
2) The proposed variation to the rear elevation would result in a dwelling extended to a cumulatively disproportionate degree having regard to the level of restraint appropriate within the Green Belt. As such, the proposal would represent inappropriate development, which is, by definition, harmful to the Green Belt and should not be approved except in very special circumstances. Therefore, the proposed development would be contrary to Section 13 of the NPPF, Policy SP4 of the Central Bedfordshire Local Plan and Chapter 11 of the Central Bedfordshire Design Guide.
3) The proposed variation to create a decking area/terrace would significantly encroach into the preferential rooting space of the protected Lime trees, creating a barrier to the effective ingress of water and nutrients, which reduces the ability of the ground conditions, and its associated rooting system, to properly support rooting function. Therefore, the disturbance to the soft landscaped area, encompassing the Root Protection Area, would be unacceptable and conflict with Policies EE4 and HQ1 of the Local Plan and Section 15 of the NPPF.
