Conditions or Reasons for Planning Application - CB/25/01510/FULL
Conditions or Reasons:
1) The proposed development would result in the loss of protected designated open space, which makes a positive contribution, both visually and spatially, to the character and appearance of the wider area. The proposal would also lead to the loss of trees and hedges which positively contribute to the area, of which the proposal does not seek replacement trees. As such, the proposed dwelling would cause harm to the character and appearance of the area, in conflict with Policies EE13, EE5, HQ10 and HQ1 of the Central Bedfordshire Local Plan (2021), Section 12 and 15 of the NPPF (2024)
2) The proposed development fails to make adequate provision for off street parking, and if permitted would lead to an increase in on street parking, thereby resulting in unacceptable traffic congestion and additional hazards to users of the highway, contrary to Policy T2 and T3 of the Central Bedfordshire Local Plan, and the design principles contained within the Parking for New Developments SPD.
3) The proposal would create a cramped form of development, by way of the proposed dwelling failing to meet the Nationally Described Space Standards (NDSS) in relation to minimum internal floor area. The proposal would also fail to meet the minimum back to back distances outlined within the CBDG (2023) and as a result, it is considered the proposed dwelling would have a negative impact on No.43 Almond Road's private amenity. As such, the cramped form of development would have a harmful impact by reason of overlooking on No.43 Almond Road's neighbouring amenity, contrary to Policy HQ1 of the CBLP (2021), Section 12 Paragraph 135 (f) of the NPPF (2024) and Section 11 of the CBDG.
4) The Council considers that the proposed development, by reason of its proximity lying within a 12.6km linear distance of the Ashridge Commons and Woods Site of Special Scientific Interest within the Chiltern Beechwoods Special Area of Conservation, would add to the recreational disturbance in this area likely to harm the integrity of the conservation purposes of the Chiltern Beechwoods Special Area of Conservation. In the absence of a legal obligation to secure an appropriate mitigation strategy to the satisfaction of the Local Planning Authority, the proposal would be contrary to the Habitat Regulations and Paragraphs 180 and 181 of the National Planning Policy Framework 2021 and Policy EE3 of the Central Bedfordshire Local Plan.
