Conditions or Reasons for Planning Application - CB/25/01513/PAAD
Conditions or Reasons:
1) The development hereby granted prior approval shall be completed within three years from the date of this decision.

Reason: To comply with Paragraph Q.2 (3) of Class Q of Part 3 of Schedule 2 of the Town and Country Planning (General Permitted Development) Order 2015 (as amended).
2) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those in drawing numbers 181 - 17 - P4 - Proposed Elevations - Sheet 1, 181 - 18 - P4 - Proposed Elevations - Sheet 2, 181 - 15 - P3 - Proposed Ground Floor Plan.

Reason: To safeguard the appearance of the completed development in the interests of the visual amenities of the locality.

3) The development hereby permitted shall not begin until a scheme to deal with contamination of land/ground gas/controlled waters has been submitted to and approved in writing by the local planning authority. The scheme shall include all of the following measures, unless the local planning authority dispenses with any such requirement specifically in writing:

1. A Phase II intrusive investigation report detailing all investigative works and sampling on site, together with the results of the analysis, undertaken in accordance with LCRM. The report shall include a detailed quantitative human health and environmental risk assessment.

2. A remediation scheme detailing how the remediation will be undertaken, what methods will be used and what is to be achieved. A clear end point of the remediation shall be stated, and how this will be validated. Any ongoing monitoring shall also be determined.

3. If during the works contamination is encountered which has not previously been identified, then the additional contamination shall be fully assessed in an appropriate remediation scheme which shall be submitted to and approved in writing by the local planning authority.

4. A validation report detailing the proposed remediation works and quality assurance certificates to show that the works have been carried out in full accordance with the approved methodology shall be submitted prior to first occupation of the development. Details of any post-remedial sampling and analysis to demonstrate that the site has achieved the required clean-up criteria shall be included, together with the necessary documentation detailing what waste materials have been removed from the site.

Reason: To minimise and prevent pollution of the land and the water environment and in accordance with national planning policy guidance set out in section 183 and 184 of the NPPF, and in order to protect human health and the environment.
4) The junction of the proposed vehicle access with Lower Rads End shall measure 4.8m wide for at least 8.0m into the site measured from the nearside kerbline and shall have visibility splays of 2.4m x 43.0m to the south-west and 2.4m x 36.0m to the south-east. The required vision splays shall for the perpetuity of the development remain free of any obstruction to visibility.

Reason: For the avoidance of doubt, in order to minimise danger, obstruction and inconvenience to users of the highway and the premises and to provide adequate visibility between the existing highway and the proposed access, and to make the access safe and convenient for the traffic which is likely to use it. (Policy T2, Central Bedfordshire Local Plan, section 9, NPPF)
5) Any gates provided shall open away from the highway and be set back a distance of at least 8.0 metres from the highway boundary. The gates shall be free of obstruction to opening to allow use of the turning area.

Reason: To enable vehicles to draw off the highway before the gates are opened and leave the site in forward gear. (Policy T2, Central Bedfordshire Local Plan, section 9, NPPF)
6) Before the premises are occupied all on site vehicular areas shall be surfaced in a stable and durable materials in accordance with details to be approved in writing by the Local Planning Authority. Arrangements shall be made for surface water drainage from the vehicular areas within the site to soak away within the site so that it does not discharge into the highway or into the main drainage system.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site so as to safeguard the interest of highway safety and reduce the risk of flooding and to minimise inconvenience to users of the premises and ensure satisfactory parking of vehicles outside highway limits. (Policy T2, Central Bedfordshire Local Plan, section 9, NPPF)
7) Prior to occupation, the proposed development shall be carried out and completed in all respects in accordance with the access siting and layout, parking provision, turning area and refuse collection point illustrated on the approved plan No. 11 rev P5 and defined by this permission and, notwithstanding the provision of the Town and Country Planning General Permitted Development Order 2015, (or any Order revoking or re-enacting that Order) there shall be no variation without the prior approval in writing of the Local Planning Authority.

Reason: To ensure that the development of the site is completed insofar as its various parts are interrelated and dependent one upon another and to provide adequate and appropriate access arrangements at all times. (Policies T2 and T3, Central Bedfordshire Local Plan, section 9, NPPF)
8) Prior to occupation, a scheme for the secure and covered parking of cycles on the site (including the internal dimensions of the cycle parking area, stands/brackets to be used and access thereto), calculated at one cycle parking space per bedroom, shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be fully implemented before the development is first occupied or brought into use and thereafter retained for this purpose. (See Notes to the Applicant)

Reason: To ensure the provision of adequate cycle parking to meet the needs of occupiers of the proposed development in the interests of encouraging the use of sustainable modes of transport. (Policies T2 and T3, Central Bedfordshire Local Plan, section 9, NPPF)
9) Prior to occupation, a scheme for the secure and covered parking of cycles on the site (including the internal dimensions of the cycle parking area, stands/brackets to be used and access thereto), calculated at one cycle parking space per bedroom, shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be fully implemented before the development is first occupied or brought into use and thereafter retained for this purpose. (See Notes to the Applicant)

Reason: To ensure the provision of adequate cycle parking to meet the needs of occupiers of the proposed development in the interests of encouraging the use of sustainable modes of transport. (Policies T2 and T3, Central Bedfordshire Local Plan, section 9, NPPF)
10) The retained property shown shaded brown on drawing no. 181 - 11 - P5 - Proposed Site Plan ('the Agricultural Unit') shall be used solely for the storage of non-motorised agricultural machinery and for no other purpose whatsoever save for such ancillary uses as may be reasonably necessary for the maintenance and management of the Agricultural Unit.
Reason: In the interests of safeguarding the amenity and living conditions of future occupants. (Policy CC8, Central Bedfordshire Local Plan, section 14, NPPF).
11) The associated area shaded beige on drawing no. 181 - 11 - P5 - Proposed Site Plan ('the Associated Area') shall not be used for any purpose other than providing access to and servicing the Agricultural Unit and for general access for the rest of the Land edged blue on drawing no. 181 - 04 - P3 - Location Plan.
Reason: In the interests of safeguarding the amenity and living conditions of future occupants. (Policy CC8, Central Bedfordshire Local Plan, section 14, NPPF)
12) No agricultural operations shall take place within the Agricultural Unit or the Associated Area (collectively referred to as 'the Retained Parts') as shown on drawing no. 181 - 11 - P5 - Proposed Site Plan that would give rise to noise odour or vibration materially exceeding levels typical of standard agricultural practice associated with machinery and for the avoidance of doubt the Retained Parts shall not be used for livestock husbandry- including the housing handling or keeping of animals at any time.
Reason: In the interests of safeguarding the amenity and living conditions of future occupants. (Policy CC8, Central Bedfordshire Local Plan, section 14, NPPF)
13) The Retained Parts shall not be used for the parking repair maintenance or stationing of any motorised vehicles including agricultural vehicles commercial vehicles motorcycles quad bikes or private cars whether operational or otherwise.
Reason: In the interests of safeguarding the amenity and living conditions of future occupants. (Policy CC8, Central Bedfordshire Local Plan, section 14, NPPF).
14) No operational activity outside the hours of 11.00 -15.00 Monday to Friday and 11.00-13.00 on Saturdays with no activity on Sundays and Bank Holidays excluding ongoing storage of machinery and equipment on the Retained Parts apart from general access to the Land over the Associated Area.
Reason: In the interests of safeguarding the amenity and living conditions of future occupants. (Policy CC8, Central Bedfordshire Local Plan, section 14, NPPF).
15) Apart from ongoing storage no operational activity shall take place on the Retained Parts on more than 30 days in any calendar year.
Reason: In the interests of safeguarding the amenity and living conditions of future occupants. (Policy CC8, Central Bedfordshire Local Plan, section 14, NPPF).
16) No intensification of use of the Retained Parts shall take place in respect of but not limited to livestock plant buildings or machinery without the consent of the Council.

17) This approval relates only to the details shown on the submitted plans, numbers 181 - 04 - P3 - Location Plan, 181 - 05 - P3 - Existing Site Plan, 181 - 06 - P1 - Existing Plans - Sheet 1, 181 - 07 - P1 - Existing Plans - Sheet 2, 181 - 08 - P1 - Existing Elevations - Sheet 1, 181 - 09 - P1 - Existing Elevations - Sheet 2, 181 - 10 - P2 - Proposed Ground Floor, 181 - 11 - P5 - Proposed Site Plan, 181 - 15 - P3 - Proposed Ground Floor Plan, 181 - 17 - P4 - Proposed Elevations - Sheet 1, 181 - 18 - P4 - Proposed Elevations - Sheet 2.

Reason: To identify the approved plan/s and to avoid doubt.
