Conditions or Reasons for Planning Application - CB/25/01528/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers; 240783_JW - EV Canopy - PLNG 10, 240783_JW - EV Canopy - PLNG 11, 240783_JW - EV Canopy - PLNG 12, 240783_JW - EV Canopy - PLNG 13, 240783_JW - EV Canopy - PLNG 14, 240783_JW - EV Canopy - PLNG 15, 240783_JW - EV Canopy - PLNG 16.

Reason: To identify the approved plan/s and to avoid doubt.
3) No part of the development hereby permitted shall commence until a Construction Traffic Management Plan has been submitted and agreed in writing by the Local Planning Authority (in consultation with the Highway Authority for the A1 Trunk Road). Construction of the development shall then be carried out in accordance with the agreed Construction Traffic Management Plan.

Reason: This is a pre-commencement condition to mitigate any adverse impact from the development on the A1 Trunk Road in accordance with DfT Circular 01/2022 and Section 9 of the NPPF.
4) Prior to commencement of the development, details of external artificial lighting shall be submitted to and approved in writing by the Council. Lighting contours shall be submitted to demonstrate that the vertical illumination of neighbouring premises is in accordance with the recommendations of the Institution of Lighting Professionals in the 'Guidance Note 1 for the Reduction of Obtrusive Light'. Details should also be submitted for approval of measures to minimise use of lighting and prevent glare and sky glow by correctly using, locating, aiming and shielding luminaires. Lighting colour shall be warm in appearance and not exceeding a temperature of 4000 kelvin (K). Approved details shall be implemented prior to occupation of the development and thereafter be permanently retained with the exception of specific changes to the lighting details that are requested by the Local Planning Authority in writing to address statutory nuisance.

Reason: This is a pre-commencement condition to ensure any external artificial lighting would protect the visual amenities of the site and surrounding area, and avoid glare or undue distraction to road users in the interest of road safety (Sections 9 and 12, NPPF).
5) Prior to the use of the development hereby approved, the FRA & Drainage Strategy (References: 5675/2025 Revision B, Astwick Services- FRA, April 2025 and 25021-DCE-XX-XX-T-C-001-P02, 25/06/2025) shall be implemented, and shall be maintained as approved thereafter. Any variation to the connections and controls indicated on the approved drawing which may be necessary at the time of construction would require the resubmission of those details to the Local Planning Authority for approval.

Reason: To ensure the approved system will function to a satisfactory minimum standard of operation and maintenance and prevent the increased risk of flooding both on and off site, in accordance with Policies CC3, CC4 and CC5 of the Central Bedfordshire Local Plan and Section 14 of the NPPF.
6) The development hereby approved shall be completed and mainained in accordance with the Maintenance and Management Plan as submitted, reference; 25021-DCE-XX-XX-T-C-001-P02, 25/06/2025.

Reason: To ensure that the implementation and long term operation of a sustainable drainage system (SuDS) is in line with what has been approved, in accordance with Policies CC3, CC4 and CC5 of the Central Bedfordshire Local Plan and Section 14 of the NPPF.
7) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those of drawing number; 240783_JW - EV Canopy - PLNG 13.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials in the interests of the visual amenities of the locality.
