Conditions or Reasons for Planning Application - CB/25/02562/FULL

Conditions or Reasons:

1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

2) A landscape and ecological management plan (LEMP) shall be submitted to, and be approved in writing by the local planning authority, prior to the first use of the development. The content of the LEMP shall include the following.

a) Description and evaluation of features to be managed.
b) Ecological trends and constraints on site that might influence management.
c) Aims and objectives of management.
d) Appropriate management options for achieving aims and objectives.
e) Prescriptions for management actions.
f) Preparation of a work schedule (including an annual work plan capable of being rolled forward over a five-year period across the 30 years.)
g) Details of the body or organization responsible for implementation of the plan.
h) Ongoing monitoring and remedial measures.

The LEMP shall also include details of the legal and funding mechanism(s) by which the long-term implementation of the plan will be secured by the developer with the management body(ies) responsible for its delivery. The plan shall also set out (where the results from monitoring show that conservation aims and objectives of the LEMP are not being met) how contingencies and/or remedial action will be identified, agreed and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme. The approved plan will be implemented in accordance with the approved details.

Reason: To ensure the longevity of the landscaping scheme and the ecological enhancement area and to protect the biodiversity value of the site and the visual amenity and character of the area, in accordance with Policy EE2 of the Central Bedfordshire Local Plan (2021)

3) The use of the wagons hereby permitted shall only be used for accommodation ancillary to the recreational fishing lakes enterprise known as Manor Farm Lakes. The accommodation shall be occupied only for holiday purposes, not as a person's sole or main place of residence.

Reason: The site lies in outside of any recognised Settlement Envelope, whereby any permanent accommodation would be in conflict with Policy SP7, and in the interest of protecting the character and appearance of the rural surroundings, in accordance with Policies EMP4 and HQ1 of the Central Bedfordshire Local Plan (2021)

4) No more than one wagon shall be stationed within each Wagon Area identified on Drawing No. 25.052.DK0001.P2. The wagons hereby permitted shall not exceed 8.5 metres in length and 3.6 metres in width and shall be externally finished in timber cladding. No replacement wagon exceeding these dimensions, or materially differing in its external appearance, shall be stationed on the land at any time without the prior written approval of the Local Planning Authority.

Reason: In the interest of protecting the character and appearance of the rural surroundings, in accordance with Policies EMP4, EE5 and HQ1 of the Central Bedfordshire Local Plan (2021)

5) All ecological measures and/or works shall be carried out in accordance with the details contained in the May 2025 Preliminary Ecological Appraisal as already submitted with the planning application and agreed in principle with the local planning authority prior to determination (or any equivalent document submitted to include updated survey results).

Reason: To ensure that works are ecologically sensitive and do not result in adverse impacts to protected species, in accordance with Policies EE2 and EE3 of the Central Bedfordshire Local Plan (2021).

6) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 25.052.DK0001.P2; 25.052.DL0101.P1; 25.052.DX0001.P1

Reason: To identify the approved plan/s and to avoid doubt.
