Conditions or Reasons for Planning Application - CB/25/02648/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers: CBC-001, SBL JNW 002 Rev:1, SBL JNW 003, SBL JNW 004, SBL JNW 005, WWS EL 002 Rev: 1, WWS FP 003 Rev: 2, WWS PV 004.

Reason: To identify the approved plan/s and to avoid doubt.
3) The first floor window(s) in the side elevation serving the en-suite of the development hereby permitted shall be permanently fitted with obscured glass of a type to substantially restrict vision through it at all times and shall be non-opening, unless the parts of the window(s) which can be opened are more than 1.7m above the floor of the room(s) in which the window(s) is installed.

Reason: To safeguard the privacy of occupiers of adjoining properties
(Section 12, NPPF)
4) Prior to development, a BS 5837 : 2012 Tree Survey, Tree Constraints Plan, Arboricultural Impact Assessment, Tree Protection Plan and an Arboricultural Method Statement, prepared by a suitably qualified arboricultural consultant, shall be submitted to the Local Planning Authority for approval, to demonstrate that the above and below ground constraints presented by adjacent trees, and their necessary tree protection measures, have been adequately considered in the design process. The approved Tree Protection Plan and Arboricultural Method Statement shall then be implemented in strict accordance with the required sequence of operations, with all tree protection fencing and /or ground protection remaining securely in position throughout the entire course of development works.

Reason: This is a pre-commencement condition to ensure that the necessary tree protection requirements have been identified and accommodated within the development scheme, and that all working practices conform to the requirements of the Arboricultural Method Statement (Policy EE4 of the CBLP and Section 15 of the NPPF).
5) Prior to the development being brought into use, the parking layout shown on the approved plan number: SBL JNW 005 shall be implemented on site and shall remain in place unless otherwise agreed in writing by the Local Planning Authority.

Reason: To ensure the provision of car parking clear of the highway.

6) The garage hereby permitted shall be kept available for the parking of motor vehicles at all times. The garage shall be used solely for the benefit of the occupants of the dwelling of which it forms part and their visitors and for no other purpose and permanently retained as such thereafter.

Reason: to ensure satisfactory parking of vehicles (Policies T2 and T3 of the CBLP and Section 9 of the NPPF).
7) Prior to the occupation of the dwelling at the site, a scheme for the provision of waste receptacles for the dwelling shall be submitted to and agreed in writing by the Local Planning Authority. The receptacles shall be provided before occupation takes place.

Reason: In the interest of residential amenity and to reduce waste generation in accordance with Policy EE14 of the CBLP.
8) All external works hereby permitted shall be carried out in materials to those detailed on Application Form Received: 05.09.25.

Reason: To safeguard the appearance of the completed development in the interests of the visual amenities of the locality.

9) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
10) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
11) Notwithstanding, The Town and Country Planning (Use Classes) Order 1987 and The Town and Country Planning (General Permitted Development)(England) Order 2015 (or any order revoking and/or re-enacting those orders with or without modification), the dwelling hereby permitted shall be constructed as a self-build dwelling within the definition of self-build and custom housing in the 2015 Self-Build and Custom Housebuilding Act (as amended by the 2016 Housing and Planning Act):

(i) The first occupation of the dwelling in the development shall be by persons who had a primary input into the design and layout of the dwelling.

Reason: To ensure the development complies with the self-build and custom house building definition and help to meet the Councils self-build requirement.
12) Prior to the construction of vehicular parking areas associated with the approved dwelling, a scheme for the charging of electric and ultra-low emission vehicles shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall accord with Policy T5 of CBLP or the most up to date guidance and shall include the following:
Details of active charging posts or passive provision such as cabling and electricity supply for the dwelling
Timescales / triggers for implementation of the scheme.

The development shall be completed in accordance with these approved details including the agreed timescales / triggers.
Reason: To assist with the transition to low-emission vehicles in line with Policy T5 of the CBLP and the National Planning Policy Framework.
13) The dwelling hereby approved must comply with the water efficiency standard of 110 litres per person per day as detailed by Regulation 36(2)(b) of Part G of Schedule 1 and Regulation 36 to the Building Regulations 2010 (as amended).

Reason: To ensure the efficient use of water in accordance with Policy CC1 of the Central Bedfordshire Local Plan (2021) and the objectives of sustainability set out in the NPPF (2024).
