Conditions or Reasons for Planning Application - CB/25/03347/FULL
Conditions or Reasons:
1) The proposed development and first floor balcony, by reason of its design and siting, would, in any event, afford a clear and unimpeded view into the rear garden immediately to the northwest of the proposal at No.2 Mill Road. Therefore, the proposal results in an unacceptable degree of overlooking and loss of privacy, contrary to Policy HQ1 of the CBLP, Section 12 of the NPPF and Chapter 11 of the CBDG.
2) The proposed development, would not meet the requirements of Policy H2 of the Local Plan for adaptable and accessible homes from all future developments. Moreover, due to the siting, scale and design of the private and communal amenity spaces for the proposed ground and first floor flats, the proposal would fail to provide acceptable and high quality living standards for future occupants. Therefore, the proposal would be contrary to Policies HQ1 and H2 of the CBLP, Section 12 of the NPPF and Chapter 11 of the CBDG.
3) The proposed development, if permitted, would lead to an increase in residential properties with a reduction of existing parking provision on a site of circa 20 existing properties with inadequate on site parking provision, and will lead to displaced parking and further on street ad hoc parking, which will cause obstruction and additional hazards to users of the highway and inconvenience to the existing residents of the site and users of the highway to the detriment to highway safety. As such, the proposal is contrary to Policies T2 and T3 of the CBLP, the Parking Standards for New Developments SPD, the Highway Construction Standards and Specifications Guidance (2019) and Section 9 of the NPPF.
