Conditions or Reasons:
1) Permitted development rights under Schedule 2, Part 2, Class A of The Town and Country Planning (General Permitted Development) (England) Order/596 2015 ('the Order') are not available by virtue of Article 3(5)(b) of the Order. The fencing and gates form an integral part to the making of the material change of use of the land and had been erected to facilitate the unauthorised change of use from an agricultural field to an enclosed dog walking and exercising area. There is sufficient evidence to demonstrate that the operational development is directly connected to an unauthorised change of use. As a result, the application does not, on the balance of probabilities, establish that the erection of the fencing and gates constitutes lawful operational development under the Act.
