Conditions or Reasons for Planning Application - CB/26/00376/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 2019-1270/ rev C; 2019-1271/ rev A

Reason: To identify the approved plan/s and to avoid doubt.
3) Notwithstanding the changes of use permitted within Part 3 of Schedule 2 of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order
revoking or re-enacting that Order with or without modification), the building illustrated as Unit 1A on drawing number ref: 2019-1271 Rev B shall only be used, or part used, for:

(A) A use falling within Use Class E (d) defined as Indoor sport, recreation or fitness (not involving motorised vehicles or firearms or use as a swimming pool or skating rink), or

(B) A use falling within Use Class E sub section (g) defined as a "use, or part use, for all or any of the following purposes:

a. for an office to carry out any operational or administrative functions,
b. the research and development of products or processes, or
c. any industrial process,
being a use, which can be carried out in any residential area without detriment to
the amenity of that area by reason of noise, vibration, smell, fumes, smoke, soot,
ash, dust or grit"; or

(C) A use within Use Class B8 defined as a "use for storage or as a distribution centre".

and no other purpose, including any other purpose falling within Class E of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended) (or any
provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification).
4) The planting and landscaping scheme shown on approved Drawing ref: 2019-1270/ rev C shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season shall mean the period from October to March). The trees, shrubs and grass shall subsequently be maintained for a period of five years from the date of planting and any which die or are destroyed during this period shall be replaced during the next planting season with others of a similar size and species.

Reason: To ensure an acceptable standard of landscaping.

5) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
6) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
7) Before the development is brought into use, the proposed development (Unit 1A) shall be carried out and completed in all respects in accordance with the access, siting
and layout illustrated on the approved plan No. 2019-1271 Rev B and defined by this permission and, notwithstanding the provision of the Town and Country Planning
General Permitted Development Order 2015, (or any Order revoking or re-enacting that Order) there shall be no variation without the prior approval in writing of the Local
Planning Authority.

Reason

To ensure that the development of the site is completed insofar as its various parts are interrelated and dependent one upon another and to provide adequate and appropriate
access arrangements at all times (Policies T2 and T3, Central Bedfordshire Local Plan, 2021)
8) No part of the development shall be occupied until the scheme for car parking (with access thereto) has been provided in accordance with the approved plans. A total of twelve car parking spaces within the parking area shown in approved drawing ref: 2019-1271 Rev B shall thereafter be kept available for parking at all times for the sole use of Unit 1A.

Reason

To ensure adequate provision for car parking space within the site to allow vehicles to draw off and park clear of the highway to minimise danger, obstruction and inconvenience to users of the adjoining access road and highway (Policies T2 and T3, Central Bedfordshire Local Plan, 2021)
9) The development hereby approved shall be implemented in full accordance with a "cellweb" or equivalent grass reinforced area, as shown on approved drawing ref: 2019-1270/ rev C and shall be retained and maintained for the lifetime of the development.

Reason

In the interests of the visual amenities of the area, and reducing flood risk (Policies HQ1, CC3 and CC5, Central Bedfordshire Local Plan, 2021)
