Conditions or Reasons for Planning Application - CB/26/00404/FULL
Conditions or Reasons:
1) The change of use of the land to equestrian, stable building, associated access with erection of fencing, hardstanding, fencing and gate represents inappropriate development in the Green Belt, which is, by definition, harmful to the Green Belt. The development is also detrimental to the openness and visual amenity of the Green Belt, in a spatial and visual sense. No factors which could amount to very special circumstances to clearly outweigh the harm to the Green Belt, are evident. The proposal is therefore contrary to Policy SP4 of the Central Bedfordshire Local Plan (2021), and Section 13 of the National Planning Policy Framework (2024).
2) The proposed change of use of the land to equestrian, stable building, associated access with erection of fencing, hardstanding, fencing and gate fencing would result in an unacceptable harmful visual impact on the character and appearance of the open countryside in this rural location. In addition, the proposed conifer planting along the boundary of the site would create a planting form that would be incongrous to the surrounding landscape. Therefore, the proposal would not respect the character and beauty of the open countryside, nor would it conserve and/ or enhance the character and appearance of the area. As such, the proposal is contrary to Policies DC4, EE4, EE5 and HQ1 of the Central Bedfordshire Local Plan (2021) and Sections 12 and 15 of the National Planning Policy Framework (2024).
3) Insufficient information has been provided to demonstrate that the neighbouring occupiers of Fourways and Bali Hiai would not be unacceptably impacted by nuisance, odour and pests generated by the development. The development is therefore in conflict with Policies DC4, CC8 and HQ1 of the Central Bedfordshire Local Plan (2021).
4) Insufficient information has been submitted to demonstrate that the proposal will not have an adverse impact on protected species, and therefore the requirement for any mitigation is also unknown. In addition, further information is required to demonstrate that the proposal would be able to deliver a mandatory net gain for biodiversity. As such, the proposal is contrary to Policies DC4 and EE3 of the Central Bedfordshire Local Plan (2021), Section 15 of the National Planning Policy Framework and Schedule 7A of the Town and Country Planning Act 1990 (as inserted by Schedule 14 of the Environment Act 2021).
