Conditions or Reasons:
1) 1. The proposal would result in a loss of residential accommodation which is contrary to Policy H8 of the South Bedfordshire Local Plan, Policy H7 of the South Bedfordshire Local Plan First Review Deposit (and Proposed Pre-Inquiry Changes) whereby proposals for change of use from residential to non-residential purposes will be resisted except where it can be demonstrated that the accommodation is unsuitable for continuing domestic use because of its form, location and setting and that it would be impractical to renovate or alter the accommodation for residential use. 2. The proposed single storey rear extension would result in the loss of a mature Beech tree protected by a Tree Preservation Order and which makes a significant contribution to the amenity and character of the area. The removal of the tree would be contrary to Policies 8 and 10 of the Bedfordshire Structure Plan 2011, Policies NE6 and BE11 of the South Local Plan and Policies NE4 and BE8 of the South Bedfordshire Local Plan First Review Deposit (and Proposed Pre-Inquiry Changes). 3. The proposed partial change of use to care agency is likely to lead to undue noise, disturbance and general activiy, and additional traffic congestion amounting to an overintensive use of the premises, harmful to the residential amenity which neighbouring occupiers could reasonably expect to enjoy and harmful to the established character of this part of Dunstable which comprises dwellinghouses solely in single family accommodtion. The proposal is therefore contrary to Policy 10 of the Bedfordshire Structure Plan 2011, Policy BE11 of the South Bedfordshire Local Plan and Policy BE8 of the South Bedfordshire Local Plan First Review Deposit (and Proposed Pre-Inquiry Changes). 4. If permitted, the proposal would create a precedent whereby it would be difficult for the District Planning Authority to resist similar proposals to the further detriment of the residential character of the locality.
