Conditions or Reasons:
1) 1. The development shall begin not later than five years from the date of this permission. REASON: To comply with Section 91 of the Town and Country Planning Act 1990. 2. Within twelve months of the access first being brought into use, a tree shall be planted on the land in such position and of such species as may be approved in writing by the District Planning Authority. If the tree is removed, dies, is severely damaged or becomes seriously diseased within three years of planting it shall be replaced with a tree of similar size and species to that originally required to be planted. REASON: To comply with Section 197 of the Town and Country Planning Act 1990 and to secure the planting of a longer term replacement tree for the existing Oak. (Policies 8, 10, B.S.P; BE11, S.B.L.P; BE8, S.B.L.P.F.R.D.). 3. All on site vehicular areas shall be surfaced in a manner to the District Planning Authority's approval so as to ensure satisfactory parking of vehicles outside highway limits. Arrangements shall be made for surface water from the site to be intercepted and disposed of separately so that it does not discharge into the highway. REASON: In order to minimise danger, obstruction, and inconvenience to users of the highway and of the premises. (Policies 42, B.S.P; T13, S.B.L.P; TI4, S.B.L.P.F.R.D.). 4. This permission relates only to the details shown on the Revised Site and Location Plan Drawing No. AH-4-1A received 10/09/01 or to any subsequent appropriately endorsed revised plans. REASON: To identify the approved plans and to avoid doubt. INFORMATIVE ----------- 1. The Oak tree adjacent to the proposed access is of a poor form with no central leader and has extensive pruning wounds along the main trunk, some of which show evidence of fungal decay. In order to successfully retain the Oak tree it would be necessary to allow a 3 metre radius protection zone, measuring outwards from the main trunk. This would of course restrict the available space in which to position the new vehicle access. It may therefore be preferable in the longer term to remove the tree and plant a replacement tree in a more suitable location. (See condition 2 above). 2. The applicant is advised that no works associated with the construction of the vehicular access should be carried out within the confines of the public highway without prior consent, in writing, of the Development Planning and Control Group, Bedfordshire County Council, County Hall, Bedford, MK42 9AP. The applicant is also advised that if any of the works associated with the construction of the vehicular access affects or requires the removal and/or the relocation of any equipment, apparatus or structures (e.g. street name plates, bus stop signs or shelters, statutory authority equipment etc) then the applicant will be required to bear the cost of such removal or alteration. NOTE ---- In accordance with the Town and Country Planning (General Development Procedure) (England) (Amendment) Order 2000, the reason for any condition above relates to the Policies as referred to in the Bedfordshire Structure Plan 2011 (B.S.P.), South Bedfordshire Local Plan (S.B.L.P) and South Bedfordshire Local Plan First Review Deposit (and Proposed Pre-Inquiry Changes) (S.B.L.P.F.R.D.).
