Conditions or Reasons: | 1)
1. The development shall begin not later than five years from the date of this permission. REASON: To comply with Section 91 of the Town and Country Planning Act 1990. 2. The premises shall be used for a restaurant, cafe or take-away and for no other purpose including any other purpose in Class A3 of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (or any order revoking and re-enacting that Order). REASON: In the interest of highway safety and residential amenity. (Policies 53, B.S.P; BE11, S.B.L.P; BE8, S.B.L.P.F.R.D.) 3. The premises hereby granted permission shall not be open to customers outside the hours of 9.00am to 11.00pm Sunday to Thursday and 9.00am to 12.00am Friday and Saturday. REASON: To protect the amenities of the occupiers of the neighbouring premises. (Policies BE11, S.B.L.P; BE8, S.B.L.P.F.R.D.) 4. All plant, machinery and equipment (including refrigeration and air conditioning systems, and public address and other amplified sound systems) to be used by reason of this permission shall be so installed, maintained and operated as to prevent the transmission of noise and vibration into any neighbouring premises and places of public resort. A scheme providing for the attenuation of noise and vibration shall be submitted to and approved in writing by the District Planning Authority before works commence on site. REASON: To prevent nuisance from noise and vibration and to safeguard the amenities of the area. (Policies BE11, S.B.L.P; BE8, S.B.L.P.F.R.D.). 5. Before development begins, details of a fume extractor to include its siting, shall be submitted to and approved in writing by the District Planning Authority. The fume extractor as approved shall be installed in the premises in the approved position before the use commences and shall subsequently be retained in full operational condition. REASON: To protect the amenities of the surrounding area. (Policies BE11, S.B.L.P; BE8, S.B.L.P.F.R.D.). 6. Foul water flows from the take-away shall pass through fat/oil/grease interception facilities, designed and constructed to the satisfaction of the District Planning Authority. REASON: To prevent blockages occurring in the public sewer. (Policies IS4, S.B.L.P; IS4, S.B.L.P.F.R.D.) 7. Within two months of the date of this permission, details of a shop window display shall be submitted to and approved in writing by the District Planning Authority. The window display, as approved, shall be implemented within 2 months of the date of approval and shall thereafter be maintained in accordance with the approved details. REASON: To avoid the creation of dead frontage and to create an element of interest for passers by. (Policies 53, B.S.P; BE11, S.B.L.P; BE8, S.B.L.P.F.R.D.) 8. This permission relates only to the details shown on the Site Location Plan received 01/10/01 or to any subsequent appropriately endorsed revised plan. REASON: To identify the approved plan and to avoid doubt. INFORMATIVE ----------- The applicant is advised to supply detail to the Environmental Health Division, before commencement of works, of the layout and of the food handling process including finishes to walls, floors, ceilings and preparation surfaces. NOTE ---- In accordance with the Town and Country Planning (General Development Procedure) (England) (Amendment) Order 2000, the reason for any condition above relates to the Policies as referred to in the Bedfordshire Structure Plan 2011 (B.S.P.), South Bedfordshire Local Plan (S.B.L.P.) and South Bedfordshire Local Plan First Review Deposit (and Proposed Pre-Inquiry Changes) (S.B.L.P.F.R.D.) |
