1 )The applicant should note that even if the land adjacent to the public footpath belongs to the curtilage of 71 High Street Wrestlingworth, it is likely that this path has been used in excess of 20 years 'as of right' and therefore is a public highway. The applicant is therefore advised that: (i) any development undertaken must occur within the bounds of the property's curtilage; (ii) it is advised that no development should encroach upon the public footpath adjacent to the site, regardless of whether or not it is within the applicant's curtilage. If this land is developed it may result in a legal order being made to add the path to the Definitive Map and Statement of Public Rights of Way which in turn may result in the need to remove the wall of the proposed conservatory, which encroaches upon the existing path, at the applicant's expense. Upon receipt of this Notice of Planning Approval, the applicant is advised to write to Bedfordshire County Council's Customer Contact Centre, 6th Floor, County Hall, Bedford, MK42 9AP quoting the Planning Application number and supplying a copy of the Decision Notice and a copy of the approved plan.
