)The applicant is advised that no works associated with the construction of the vehicular access should be carried out within the confines of the public highway without prior consent, in writing, of the Bedfordshire County Council. Upon receipt of this Notice of Planning Approval, the applicant is advised to write to Bedfordshire County Council's Customer Contact Centre, 6th Floor, County Hall, Bedford, MK42 9AP quoting the Planning Application number and supplying a copy of the Decision Notice and a copy of the approved plan. This will enable the necessary consent and procedures under Section 184 of the Highways Act to be implemented. )The applicant is advised that photographs of the existing highway that is to be used for access and the delivery of materials will be required by the Local Highway Authority. Any subsequent damage to the public highway resulting from the works as shown by the photographs, including damage caused by delivery vehicles to the works, will be made good to the satisfaction of the Local Highways Authority at the expense of the applicant. Attention to drawn to Section 59 of the Highways Act 1980 in this respect.The applicant is advised that photographs of the existing highway that is to be used for access and the delivery of materials will be required by the Local Highway Authority. )The Bedfordshire County Council Rights of Way Officer has commented that it is noted that the applicant is applying to divert Footpath 21 along the route/alignment shown on the submitted drawing number 04119 (D) 102, no Orders have been made to change the alignment to that shown on drawing number 04119 (D) 102.
The Bedfordshire County Council Rights of Way Officer further advises that until such time as an Order is confirmed, the Footpath 21 should not be obstructed as a consequence of the development proposed or development activities associated with the development, such as materials storage, parking of machinery or new means of enclosure.The Bedfordshire County Council Rights of Way Officer has commented that it is noted that the applicant is applying to divert Footpath 21 along the route/alignment shown on the submitted drawing number 04119 (D) 102, no Orders have been made to change the alignment to that shown on drawing number 04119 (D) 102.

)Whilst the Bedfordshire Bat Group has not commented on this application and the applicants Barn Owl and Bat Survey concludes that Barn Owls do not nest and Bats do not roost at the site. However that there is some evidence of the presence of both species.
The Survey recommends that further checks should be made prior to the commencement of development and that if necessary works are not carried out from March to September.
Accordingly an appropriate planning condition has been imposed.
Attention is also drawn to the requirements of the relevant legislation in the Wildlife and Countryside Act 1981 (as amended) and the need to advise contractors and others associated with the development works accordingly.Whilst the Bedfordshire Bat Group has not commented on this application and the applicants Barn Owl and Bat Survey concludes that Barn Owls do not nest and Bats do not roost at the site.
