1 )The change of use shall not be implemented unless and until highway rights have been extinguished across the area of land hatched red as indicated on plan ref CBC/04 in accordance with a stopping up order to be made by the Secretary of State for Transport, Government Office for the East of England, under Section 247 of the Town and Country Planning Act 1990, or by application to the highway authority for the stopping up of highway land via the magistrates court under Section 117 of the Highways Act 1980.The change of use shall not be implemented unless and until highway rights have been extinguished across the area of land hatched red as indicated on plan ref CBC/04 in accordance with a stopping up order to be made by the Secretary of State for Transport, Government Office for the East of England, under Section 247 of the Town and Country Planning Act 1990, or by application to the highway authority for the stopping up of highway land via the magistrates court under Section 117 of the Highways Act 1980.
2 )If during any site investigation, excavation, engineering or construction works evidence of land contamination is identified, the developer is advised to notify the Public Protection Team and The Environment Agency without delay.
