Informative Notes:
1 )The applicant is advised that the question of lawful use, as distinct from permitted development rights, is an entirely separate issue which is of no relevance in relation to the lawful use of any part of the property. The Local Planning Authority do not consider this land to be considered 'curtilage' land to No.95 High Street with the benefit of permitted development rights. Accordingly, the development works on this parcel of land are unlawful for the permitted development rights granted by Class E of Part 1 of Schedule 2 of the Town and Country Planning (General Permitted Development) Order 1995 as amended which do not extend to the subject land. The applicant is advised that the question of lawful use, as distinct from permitted development rights, is an entirely separate issue which is of no relevance in relation to the lawful use of any part of the property.
