This part of Chapel Close is private but is currently going through the Sec 38 process. Any alterations to the layout of the site should be made via the developer also, so they may amend the plan (which has already been submitted) for the Section 38. The applicant should contact the developer to ascertain that the proposal will not affect the adoption process.
The applicant should also be made aware that any foundations, or part of the fence can not be installed/constructed in, under or overhanging the public highway. As such the alignment of the fence may need to be moved a little into the site away from the edging kerbs which mark the extent of the boundary.You are advised to note the comments of the Highway Officer:
