3 )NatureSpace Certificate informatives It is recommended that the NatureSpace Best Practice Principles are taken into account and implemented where possible and appropriate. It is essential to note that any works or activities whatsoever undertaken on site (including ground investigations, site preparatory works or ground clearance) prior to receipt of the written authorisation from the planning authority which permits the development to proceed under the District Licence (WML-OR152, or a 'Further Licence') are not licensed under the great crested newt District Licence. Any such works or activities have no legal protection under the great crested newt District Licence and if offences against great crested newt are thereby committed then criminal investigation and prosecution by the police may follow. It is essential to note that any ground investigations, site preparatory works and ground / vegetation clearance works / activities (where not constituting development under the Town and Country Planning Act 1990) in a red zone site authorised under the District Licence but which fail to respect controls equivalent to those detailed in the planning condition above which refers to the NatureSpace great crested newt mitigation principles would give rise to separate criminal liability under the District Licence, requiring authorised developers to comply with the District Licence and (in certain cases) with the GCN Mitigation Principles (for which Natural England is the enforcing authority); and may also give rise to criminal liability under the Wildlife & Countryside Act 1981 (as amended) and/or the Conservation of Habitats and Species Regulations 2017 (as amended) (for which the Police would be the enforcing authority). The licence requires authorisations to specify which activities and operations are permitted from the list in Annex B of WML-OR152. In this case, the licensed activities and operations will be as follows: A5, A6, A7, A8, A11 The following Protocol conditions will apply: P1, P2, P3, P4, P5, P8, P11, P12 Please see Annex 1 of the NatureSpace Certificate ref: NSP693CBC, dated 9th May 2024, for full details of these activities and operations. Once authorised, developers working under the District Licence also should note: - 'Authorised developers' authorise (in writing) additional persons (e.g., employees, contractors) to act as 'Accredited Agents' under the District Licence; - Authorised developers must ensure that all persons using the licence (including any Accredited Agents) must possess appropriate knowledge, training and experience to undertake licensed activities in accordance with the District Licence and accepted best practice; - Developers must maintain a record of activities carried out under the District Licence and a list of any persons you authorise to act as 'Accredited Agents' - and provide a record of these activities and persons to Central Bedfordshire Council or NatureSpace Partnership in a timely manner; - It is a condition of any authorisation under the District Licence that reasonable requests for permission to access the site will granted to employees and representatives of the Planning Authority and or Natural England for monitoring purposes; - It is recommended that the attached Best Practice Principles are followed for all works on site. 4 )We would expect some above ground sustainable drainage features (as per our SuDS SPD). Some SuDS features/diversity enhancement in all phases. We will require a full set of calculations for each phase and in total, providing evidence of all surface water retained on site for the 1 in 100 (+30%CC). Any exceedance should be shown with pathways, depths and velocity. We will require full drainage drawings showing all connections, control features, storage, inverts etc. and how it communicates with the development wide scheme. Surface mounted raingardens have been used to provide attenuation and decoration in other similar areas. Any watercourses (this includes culverted) within or adjacent to the site should be included in the maintenance and management plan, even if there is no discharge to them. This would be a riparian ownership issue but leaving it as such is no longer acceptable. The connection of private surface water drainage systems to a highway system is not permitted. The final detailed design including proposed standards of operation, construction, structural integrity and ongoing maintenance must be compliant with the 'Non-statutory technical standards for sustainable drainage systems' (March 2015, Ref: PB14308), 'Central Bedfordshire Sustainable Drainage Guidance' (Adopted April 2014, Updated May 2015), and recognised best practise including the Ciria SuDS Manual (2016, C753). Culverting of existing watercourses will not be permitted. Under Central Bedfordshire Council and IDB bylaws, any watercourse within or adjoining the site boundary will maintain a 9m development free easement (on the development side), unless otherwise agreed with the relevant drainage authority. This applies to all watercourses, where water is present for all or some of the year, including those not clearly stated on mapping, topography or planning documents. Permeable block paving should be laid to CIRIA C768 'Guidance on the construction of SuDS' guidelines. This guidance also stipulates following Interlay guidance. The Council does not, and is not required to, adopt any SuDS feature. It is the responsibility of the applicant to ensure that the surface water drainage system, in its entirety, will be effectively maintained in the long-term. We therefore expect confirmation of the proposed arrangements for maintenance to be provided with the final detailed design, including the future maintenance and operational needs and the responsible bodies for undertaking maintenance (for all public and private drainage components).
