3 )Will a new extension affect your Council Tax Charge? The rate of Council Tax you pay depends on which valuation band your home is placed in. This is determined by the market value of your home as at 1 April 1991. Your property's Council Tax band may change if the property is extended.  The Council Tax band will only change when a relevant transaction takes place. For example, if you sell your property after extending it, the new owner may have to pay a higher band of Council Tax. If however you add an annexe to your property, the Valuation Office Agency may decide that the annexe should be banded separately for Council Tax.  If this happens, you will have to start paying Council Tax for the annexe as soon as it is completed. If the annexe is occupied by a relative of the residents of the main dwelling, it may qualify for a Council Tax discount or exemption.  Contact the Council for advice on 0300 300 8306. 4 )The applicant should be aware that it appears the legal line of Public Footpath No.16 is either obstructed or there is a used route anomaly. The applicant should therefore consider applying for a public footpath diversion order to avoid any future issues. The footpath needs to remain safely useable by the public at all times. If a temporary closure or diversion of the public footpath is considered necessary on public safety grounds, especially when the existing garage is demolished, the applicant must apply for a closure order giving the Council at least 6 weeks notice. Information about the costs of temporary closure/diversions is available on request from Public Rights of Way or can be found on the Rights of Way pages of the Council's website. It is also reiterated that no materials or vehicles associated with the development should be left on or near the Public Footpath, so as to cause any hazard, obstruction or inconvenience to its users at any time. The Public Footpath metal signpost at Blackhill Lane would not be able to be moved without the Council's permission. The applicant should be aware that it appears the legal line of Public Footpath No.16 is either obstructed or there is a used route anomaly. 5 )The applicant is advised that parking for contractor's vehicles and the storage of materials associated with this development should take place within the site and not extend into within the public highway without authorisation from the highway authority. If necessary the applicant is advised to contact The Street Works Co-ordinator, Central Bedfordshire Highways, by contacting the Highways Helpdesk 0300 300 8301. Under the provisions of the Highways Act 1980 the developer may be liable for any damage caused to the public highway as a result of demolition/construction of the development hereby approved. The contractor and / or client are to ensure that any mud or building material debris such as sand, cement or concrete that is left on the public highway, or any mud arising from construction/demolition vehicular movement, shall be removed immediately and in the case of concrete, cement, mud or mortar not allowed to dry on the highway. The applicant is advised that parking for contractor's vehicles and the storage of materials associated with this development should take place within the site and not extend into within the public highway without authorisation from the highway authority. 6 )The applicant is advised that the boundary vegetation around the property including trees, hedgerows and scrub would provide opportunities for foraging and commuting bats within the area and any new external lighting should be minimised or directed away from these linear features. The applicant is advised that no evidence of nesting birds or previous nesting material was found in the bungalow or garage. However, a pre-works check will be required if development is brought forward during the nesting season (March to August). In the event that bird nests are confirmed prior to, or during works all works should stop and only continue when the birds have left the nest. The applicant is advised that the boundary vegetation around the property including trees, hedgerows and scrub would provide opportunities for foraging and commuting bats within the area and any new external lighting should be minimised or directed away from these linear features. 7 )The applicant is reminded that, under the Conservation of Habitats and Species Regulations 2017 (as amended) and the Wildlife and Countryside Act 1981 (as amended), it is an offence to (amongst other things): deliberately capture, disturb, injure, or kill great crested newts; damage or destroy a breeding or resting place; intentionally or recklessly obstruct access to a resting or sheltering place. Planning permission for a development does not provide a defence against prosecution under this legislation. Should great crested newts be found at any stage of the development works, then all works should cease, and a professional and/or suitably qualified and experienced ecologist (or Natural England) should be contacted for advice on any special precautions before continuing, including the need for a licence. The applicant is reminded that, under the Conservation of Habitats and Species Regulations 2017 (as amended) and the Wildlife and Countryside Act 1981 (as amended), it is an offence to (amongst other things): deliberately capture, disturb, injure, or kill great crested newts; damage or destroy a breeding or resting place; intentionally or recklessly obstruct access to a resting or sheltering place.
