)Regulation 75 of the Conservation of Habitats and Species Regulations 2017 imposes a condition on any permission granted by the General Permitted Development Order (GDPO) that is likely to have a significant effect on a European Site (Chilterns Beechwoods Special Area of Conservation) must not commence until the developer has received written notification of the approval of the local planning authority under Regulation 77.
This means that any development granted under the GPDO that will result in creation of new dwellings cannot lawfully proceed until Regulation 77 is satisfied. This includes all development that has received Prior Approval consent under the GPDO but has not been completed.
The process for this is to submit to the planning authority sufficient information for it to enable an assessment to take place. There is no statutory application form to be completed, but there is a requirement in the Regulations to pay £30 at the time of application. Central Bedfordshire Council will then inform Natural England of the application, who will be given a period to make comments, and will take these comments into account.
Following approval of the draft Chilterns Beechwoods Special Area of Conservation (SAC) Mitigation Strategy by the Council's Executive Committee on 7th February 2023, the final Mitigation Strategy has now been published on the Council website.
The Mitigation Strategy details a number of open spaces which the Council has successfully secured as Strategic Alternative Green Spaces (SANGs) to mitigate the impact of development in parts of southern Central Bedfordshire on the Chilterns Beechwoods Special Area of Conservation. The full Strategy document can be found on the Council website.
For development which cannot provide its own SANG, applicants who wish to make use of the Council's Mitigation Strategy to satisfy Regulation 75 of the Conservation of Habitats and Species Regulations 2017 in relation to their Prior Approval applications will need to complete a Unilateral Undertaking agreement which secures contributions to the Strategy. This will comprise of contributions to Part A (SAMM), Part B (SANG), as well as fees to cover monitoring and legal costs.

)Advice in relation to the Gas Pipeline:
There is a 6 inch ST IP pipeline in the works area which will need to be protected at all times this has an easement in place with BPD distance from either side of the pipeline, which must not be encroached upon crossed over or nothing to be built on or placed/stored on or over the pipelines in or on top of the pipeline or easements for all assets in the works area.
No mechanical excavation within 3m main of the IP pipeline.
The ground levels must not be altered over the pipelines or in the easement.
Nothing to be built or positioned over the pipeline, or in the easement of the above said pipeline.
Please be aware that access to the pipeline will be always required in the event of an emergency or operational maintenance needs.
