Conditions or Reasons for Planning Application - CB/19/02857/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Prior to development, tree protective fencing shall be positioned and installed in strict compliance with Section 5.4 "Protective Fencing" and the "Tree Removal and Protection Plan" (Ref. 53X010-WWA-00-XX-DR-L-0700-PO1) of the "Arboricultural Implications Assessment and Method Statement", dated November 2019 (Ref. 53X010-WWA-00-XX- RP-L-0602). The protective fencing shall then remain securely in position throughout the entire course of development works.

REASON: To ensure the protection of retained trees from development activity by securing an adequate construction exclusion zone.

3) Both prior to and throughout the course of development work, all recommended arboricultural working practice shall be carried out in strict accordance with the requirements outlined in Section 5.0 "Arboricultural Method Statement" of the "Arboricultural Implications Assessment and Method Statement", dated November 2019 (Ref. 53X010-WWA-00-XX- RP-L-0602), with specific reference to Arboricultural Monitoring (Section 5.2), Access Pruning (Section 5.3 and Table 3), and Precautionary Works (Sections 5.6, 5.7, 5.8 and 5.9).

REASON: To ensure that all working operations are in accordance with good arboricultural practice, in order to prevent damage to the retained trees during development operations.

4) No building/dwelling shall be occupied until a detailed drainage strategy has been submitted confirming the condition of the receiving drainage system, and that the discharge rates from the development (this site and Gilbert Inglefield site combined) are agreed by the Environment Agency. The final detailed design shall be based on the agreed Drainage Strategy (Ref: Peter Dann, Job No. 10-9101, October 2019) and DEFRAs Non-statutory technical standards for sustainable drainage systems (March 2018) and shall be implemented and maintained as approved. Maintenance will ensure the system functions as designed for the lifetime of the development. Any variation to the connections and controls indicated on the approved drawing which may be necessary at the time of construction would require the resubmission of those details to the Local Planning Authority for approval.

Reason: To ensure the approved system will function to a satisfactory minimum standard of operation and maintenance and prevent the increased risk of flooding both on and off site, in accordance with para 163 and 165 of the NPPF and its supporting technical guidance.
5) No building/dwelling shall be occupied until the developer has formally submitted in writing to the Local Planning Authority a finalised 'Maintenance and Management Plan' for the entire surface water drainage system, inclusive of any adoption arrangements and/or private ownership or responsibilities, and that the approved surface water drainage scheme has been correctly and fully installed as per the final approved details.

Reason: To ensure that the implementation and long term operation of a sustainable drainage system (SuDS) is in line with what has been approved, in accordance with Written Statement HCWS161, 18th December 2014.
6) Where the use of permeable surfacing is proposed, this should be designed in accordance with the 'CIRIA RP992 The SuDS Manual Update: Paper RP992/28: Design Assessment Checklists for Permeable/Porous Pavement'.

Reason: To prevent the increased risk of flooding both on and off site, in accordance with para 163 and 165 of the NPPF and its supporting technical guidance.
7) The final detailed design including proposed standards of operation, construction, structural integrity and ongoing maintenance must be compliant with the 'Non-statutory technical standards for sustainable drainage systems' (March 2015, Ref: PB14308), 'Central Bedfordshire Sustainable Drainage Guidance' (Adopted April 2014, Updated May 2015), and recognised best practice including the Ciria SuDS Manual (2016, C753).

Reason: To prevent the increased risk of flooding both on and off site, in accordance with para 163 and 165 of the NPPF and its supporting technical guidance.
8) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those outlined within the Design & Access Statement..

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match the existing building in the interests of the visual amenities of the locality. (Section 12, NPPF)
9) The promotion of sustainable travel associated with this School development should be implemented in accordance with the approved Travel Plan dated August 2019 (Revision 2).

All measures agreed therein shall be undertaken in accordance with the approved Plan. There shall be an annual review of the Travel Plan (for a period of 5 years from the date of approval of the plan) to monitor progress in meeting the targets for reducing car journeys generated by the proposal and this shall be submitted to and approved by the Local Planning Authority.

Reason: to promote sustainable transport in accordance with Chapter 9 of the NPPF
10) No community use of the new teaching block hereby permitted shall commence until a community use agreement prepared in consultation with the Council has been submitted to and approved in writing by the Local Planning Authority, and a copy of the completed approved agreement has been provided to the Local Planning Authority. The agreement shall include details of the pricing policy, hours of use, access by non-educational establishment users, management responsibilities and a mechanism for review, to secure the effective community use of the facilities. The community use agreement shall be adhered to in perpetuity.

Reason: In accordance with Paragraph 92 of the NPPF.
11) All ecological measures and/or works shall be carried out in accordance with the details contained in the August 2019 Biodiversity Enhancement Plan as already submitted with the planning application and agreed in principle with the local planning authority prior to determination.

Reason: In accordance with the aims and objectives as detailed in Chapter 15 of the NPPF.
12) Within 12 months of occupation of the proposed development a 3m wide footway/cycleway shall be constructed on the east side of the Vandyke Road between along the entire frontage of the site in accordance with details of the approved drawing/or scheme to be submitted to and approved by the Local Planning Authority.  Any Statutory Undertakers equipment or street furniture shall be re-sited to provide an unobstructed footway.

Reason: In the interests of road safety and pedestrian movement.
13) Construction management shall be undertaken in accordance with the 'Vandyke & Gilbert Inglefield delivery access plan; Master Phasing Plan & the Vandyke Upper School construction Traffic Management plan. The plan shall be monitored and updated as required.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
