Conditions or Reasons for Planning Application - CB/19/02986/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Prior to development, all tree protective fencing shall be erected in strict accordance with the "Tree Removal and Protection Plan" (Ref. No. 1938-WWA-OO-XX-DR-L-0700-PO1) and Section 4.4 "Protective Fencing" of the "Arboricultural Implications Assessment and Method Statement" , dated August 2019 (Ref. No. 1938-WWA-OO-XX-RP-L-0600-PO1). The fencing shall then remain securely in position throughout the entire course of development works, unless otherwise specified in the Method Statement.

REASON: To ensure the protection of retained trees by securing the necessary Construction Exclusion Zone, so as to ensure their health, stability and amenity value.

3) Both prior to and during development, all arboricultural monitoring, access facilitation pruning, working operations and precautionary working procedures shall strictly adhere to the working methodology specified in Section 4.0 "Arboricultural Method Statement", of the document "Arboricultural Implications Assessment and Method Statement" , dated August 2019 (Ref. No. 1938-WWA-OO-XX-RP-L-0600-PO1).

REASON: To ensure that all working procedures are carried out in accordance with good arboricultural practice, in order to prevent damage caused by inappropriate actions during development activity that could be deemed harmful to the health, stability and amenity value of retained trees.

4) Prior to installation the applicant shall submit a scheme for the management of noise from all new external fixed plant. Such scheme shall be approved in writing by the local planning authority and any works arising from the assessment shall be completed in full prior to the plant first being brought into use and thereafter maintained as such.

Reason: to protect the amenities of nearby residential properties (Section 12, NPPF)
5) Where the use of permeable surfacing is proposed, this should be designed in accordance with the 'CIRIA RP992 The SuDS Manual Update: Paper RP992/28: Design Assessment Checklists for Permeable/Porous Pavement'.

Reason: To prevent the increased risk of flooding both on and off site, in accordance with para 163 and 165 of the NPPF and its supporting technical guidance.
6) The final detailed design including proposed standards of operation, construction, structural integrity and ongoing maintenance must be compliant with the 'Non-statutory technical standards for sustainable drainage systems' (March 2015, Ref: PB14308), 'Central Bedfordshire Sustainable Drainage Guidance' (Adopted April 2014, Updated May 2015), and recognised best practice including the Ciria SuDS Manual (2016, C753).

Reason: To prevent the increased risk of flooding both on and off site, in accordance with para 163 and 165 of the NPPF and its supporting technical guidance.
7) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those outlined within the Design & Access Statement.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match the existing building in the interests of the visual amenities of the locality. (Section 12, NPPF)
8) The promotion of sustainable travel associated with this School development should be implemented in accordance with the approved Travel Plan dated August 2019 (Revision 1).

All measures agreed therein shall be undertaken in accordance with the approved Plan. There shall be an annual review of the Travel Plan (for a period of 5 years from the date of approval of the plan) to monitor progress in meeting the targets for reducing car journeys generated by the proposal and this shall be submitted to and approved by the Local Planning Authority.

Reason: to promote sustainable transport in accordance with Chapter 9 of the NPPF
9) No use of the new teaching block hereby permitted shall commence until a community use agreement prepared in consultation with the Council has been submitted to and approved in writing by the Local Planning Authority, and a copy of the completed approved agreement has been provided to the Local Planning Authority. The agreement shall include details of the pricing policy, hours of use, access by non-educational establishment users, management responsibilities and a mechanism for review, to secure the effective community use of the facilities. The community use agreement shall be adhered to in perpetuity.

Reason: In accordance with Paragraph 92 of the NPPF.
10) No use of the new teaching block hereby permitted shall commence until a landscaping scheme and a scheme for landscape maintenance for a period of five years following the implementation of the landscaping scheme shall be submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping.

11) Construction management shall be undertaken in accordance with the 'Vandyke & Gilbert Inglefield' delivery access plan; Master Phasing Plan & the Gilbert Inglefield Academy Construction Traffic Management plan. The plan shall be monitored and updated as required.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
12) Prior to the first use of the new MUGAs, a noise management plan shall be submitted to and agreed in writing by the local planning authority.  Such plan shall include the following information:

Hours of Use;
Types and Frequency of Bookings to be accepted;
How to make a complaint;
How complaints will be managed;
What the venue will do if they get repeated complaints; and
Phone number and contact details for local residents to raise complaints.

The approved noise management plan shall thereafter be adhered to at all times.
