Conditions or Reasons for Planning Application - CB/20/01537/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) If the proposed access road is not constructed to its full length as illustrated on the phasing plan, a temporary turning space for vehicles shall be constructed within the site in a position to be approved in writing by the Local Planning Authority before any building taking access from the road is occupied.

Reason:
To avoid the need for vehicles to reverse into or from the highway in the interest of road safety, in accordance with the NPPF.
3) The hard standing areas relevant to each phase of development shall be constructed in accordance with the material details shown on drawing 1492-236 (Rev Z) Site Layout Plan. The temporary haul road shall be constructed in accordance with 1492-239 (Rev A) temporary works plan. Unless otherwise approved in writing by the Local Planning Authority.
Reason: To avoid extraneous material or surface water from the site into the highway so as to safeguard the interest of highway safety, in accordance with Policy BE8 of the adopted Local Plan, Policy HQ1 of the emerging Local Plan, the adopted Design Guide and the NPPF.
4) The development shall be constructed using the materials specified on the elevation drawings: 1492-300 (rev G) Block A elevations, 1492-300 Rev G Block A Elevations, 1492-264 Rev D Block B Plans, Elevations and roof plan, unless otherwise approved in writing by the local planning authority.

Reason: To secure high quality development, in accordance with Policy BE8 of the adopted Local Plan and the NPPF.
5) No development shall commence above ground level until a scheme (based on current government policy/guidance at the time of submission) for the provision of electric charging points has been submitted to and approved in writing by the local planning authority. The charging points shall be provided as approved prior to the occupation of the buildings they serve.
Reason: To ensure the development protects and exploits opportunities for the use of sustainable transport modes for the movement of people in accordance with paragraph 105 e) of the National Planning Policy Framework 2019.
6) The construction of each phase of the development shall be undertaken in accordance with the recommendations of the Energy Statement and Sustainability Statement produced by The Energy Council dated March 2020 and a Verification Report relevant to the residential, and each commercial unit within each phase of the development in accordance with the Energy and Sustainability Statement is to be submitted prior to the occupation of each residential and commercial units within each phase of the development.

Reason: In order to secure sustainable development, in accordance with the NPPF.
7) For each of the permitted A1, A3, A5 units, prior to the installation of any plant, machinery or equipment the details of such shall be submitted to and approved in writing by the Local Planning Authority. Such details shall include noise emissions from the equipment and mitigation measures to be incorporated. The rated noise levels shall be assessed in accordance with BS4142:2014. Any scheme of mitigation shall be implemented in accordance with the approved details and it shall be retained in accordance with those details thereafter.

Reason: In the interests of maintaining adequate levels of residential amenity, in accordance with Policy BE8 of the adopted Local Plan and the NPPF.
8) Prior to the installation of any plant, machinery or equipment associated with the hereby permitted residential units, the details of such shall be submitted to and approved in writing by the Local Planning Authority. Such details shall include noise emissions from the equipment and mitigation measures to be incorporated. The rated noise levels shall be assessed in accordance with BS4142:2014. Any agreed scheme shall be implemented in accordance with the approved details, and it shall be retained in accordance with those details thereafter.

Reason: In the interests of maintaining adequate levels of residential amenity, in accordance with Policy BE8 of the adopted Local Plan and the NPPF.
9) Deliveries to the retail units shall take place between the following hours:

7am 10pm Monday to Saturday
8am 8pm Sundays and Public Holidays

The following restrictions shall be adhered to at all times for deliveries which take place before 8am:

- Vehicle reversing alarms shall be switched off prior to entering the site
- Vehicle refrigeration units shall be switched off prior to entering the site

Vehicle engines shall not be left running during deliveries at any time.

Reason: In the interests of maintaining adequate levels of residential amenity, in accordance with Policy BE8 of the adopted Local Plan and the NPPF.
10) Prior to any A5 use being brought into use, equipment shall be installed to effectively suppress and disperse fumes and/or odours produced by cooking and food preparation, and the equipment shall be operated so long as the A5 use continues. Full details of the method of odour abatement and all odour abatement equipment to be used, including predicted noise levels of the equipment in operation, shall be submitted to and approved by the Local Planning Authority prior to the installation of the equipment. The approved equipment shall be installed prior to the A5 use commencing.

Reason: In the interests of maintaining adequate levels of residential amenity, in accordance with Policy BE8 of the adopted Local Plan and the NPPF.
11) Prior to occupation of any phase of the development, details of a public art plan shall be submitted to the Local Planning Authority in writing. The public art plan shall include details of a timetable for implementation and shall agree the scale of the proposed public art. The details shall be implemented in accordance with the approved details.

Reason: In order to provide a high quality development, in accordance with Policy BE8 of the adopted Local Plan and the NPPF.
12) Prior to the occupation of any phase of the development a soft landscaping scheme in accordance with principles of the Illustrative Landscape Master Plan (P18-0598-04B) and a landscape maintenance plan covering a period of 5 years has been submitted to and approved in writing by the local planning authority. The approved scheme shall be implemented prior to the occupation of any phase of the development to which the landscaping relates to. The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To secure a high quality development, in accordance with the NPPF and Policy BE8 of the adopted Local Plan.
13) The development shall be completed and maintained in accordance with the approved travel plan (Framework Travel Plan March 2020).

Reason: In order to secure sustainable development, in accordance with Policy BE8 of the adopted Local Plan and the NPPF.
14) Prior to the commencement of works above ground level within each phase of the development, details of any proposed street lighting shall be submitted to the Local Planning Authority for approval in writing. The lighting shall be installed within each phase in accordance with the approved details prior to the first occupation of each phase of the development.

Reason: To preserve and enhance the character of the listed building and in the interests of high quality design, in accordance with Policy BE8 of the adopted Local Plan, Policy HQ1 of the emerging Local Plan and the NPPF.
15) The car parking provision shall be provided in accordance with drawing number 1492-CPAP-2 Rev.F. The car parking shall be retained thereafter in accordance with the approved plan.

Reason: To provide an acceptable level of car parking provision, in accordance with
Policy BE8 of the adopted Local Plan and the NPPF
16) The development shall be phased in accordance with the approved phasing plan (drawing number 1492-PP).

Reason: To provide certainty regarding the timing and location of future development, in accordance with Policy BE8 of the adopted Local Plan and the NPPF.
17) No building/dwelling within each phase of the development shall be occupied until the developer has formally submitted in writing to the Local Planning Authority a finalised 'Maintenance and Management Plan' for the surface water drainage system to serve the development in accordance with the Surface Water Drainage Technical Note (ref 18-0384), Inclusive of any adoption arrangements and/or private ownership or responsibilities, and that the approved surface water drainage scheme for that phase has been correctly and fully installed as per the final approved details.

Reason: To ensure that the implementation and long term operation of a sustainable drainage system (SuDS) is in line with what has been approved, in accordance with Written Statement HCWS161, 18th December 2014.
18) No development shall take place above ground level until a scheme has been submitted to and approved in writing by the Local Planning Authority for the provision of fire hydrants at the development. Prior to the first occupation of the development, the fire hydrants serving that development shall be installed as approved. Thereafter the fire hydrants shall be retained as approved in perpetuity.

Reason: In order to ensure appropriate access to fire hydrants for use in the event of emergency in accordance with policy BE8 of adopted Local Plan and Section 12 of the NPPF.
19) No development shall take place above ground level until a scheme has been submitted to and approved in writing by the Local Planning Authority for the provision of additional landscaping within the development. The landscaping shall be provided in accordance with the approved details and retained thereafter.

Reason: To secure high quality development, in accordance with Policy BE8 of the adopted Local Plan and the NPPF.
20) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers:
