Conditions or Reasons for Planning Application - CB/20/01538/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Prior to first occupation of the development hereby approved, a Landscape Maintenance and Management Plan for a period of ten years from the date of its delivery in accordance with Condition 3 shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include details of the management body, who will be responsible for delivering the approved landscape maintenance and management plan. The landscaping shall be maintained and managed in accordance with the approved details.

Reason: To ensure that the appearance of the site would be acceptable in accordance with Policy BE8 of the adopted Local Plan and the NPPF.
3) Prior to first occupation of the development hereby approved, details of hard and soft landscaping together with a timetable for its implementation shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out as approved and in accordance with the approved timetable.

Reason: To ensure that the appearance of the site would be acceptable in accordance with Policy BE8 of the adopted Local Plan and the NPPF.
4) No development shall take place above ground level until a scheme has been submitted to and approved in writing by the Local Planning Authority for the provision of fire hydrants at the development. Prior to the first occupation of the development the fire hydrants serving that development shall be installed as approved. Thereafter the fire hydrants shall be retained as approved in perpetuity.

Reason: In order to ensure appropriate access to fire hydrants for use in the event of emergency in accordance with Policy BE8 adopted Local Plan and Section 12 of the NPPF.
5) No development shall commence above ground level until a scheme (based on current government policy/guidance at the time of submission) for the provision of electric charging points has been submitted to and approved in writing by the local planning authority. The charging points shall be provided as approved prior to the occupation of the buildings they serve.

Reason: To ensure the development protects and exploits opportunities for the use of sustainable transport modes for the movement of people in accordance with paragraph 105 e) of the National Planning Policy Framework 2019.
6) Prior to the commencement of works above ground level, a site-wide lighting strategy shall be submitted to the Local Planning Authority for approval in writing. The development shall be constructed and maintained in accordance with the approved details.

Reason: To define the character of the development and to guide detailed submissions and to ensure that the details and appearance of the development are acceptable to the Local Planning Authority and in accordance with the NPPF.
7) The development shall be completed in accordance with the approved external construction materials, as shown on the submitted Material Schedule and drawing number LU5 gJH-A-05. The approved external materials shall be retained thereafter.

Reason: To secure a high quality development, in accordance with Policy BE8 of the adopted Local Plan, Policy HQ1 of the emerging Local Plan, the adopted Design Guide and the NPPF.
8) Noise resulting from the use hereby approved shall not exceed the existing background when measured or calculated according to BS4142:2014.

Reason: To protect the amenity of neighbouring residents, in accordance with the NPPF.
9) No development shall commence until a detailed surface water drainage scheme, to manage surface water runoff from the development for up to and including the 1 in 100 year event (+30%CC), and a maintenance and management plan for the scheme has been submitted to and approved in writing by the Local Planning Authority. The discharge rate from the development will be limited to the equivalent 1 in 1 year rate, or an appropriate rate as agreed by the Bedford Group of Internal Drainage Boards. The final detailed design shall be based on the agreed drainage Strategy (Ref: BSP, Feb 2020,PN 18-0384) and DEFRAs Non-statutory technical standards for sustainable drainage systems (March 2018) and shall be implemented and maintained as approved. Maintenance will ensure the system functions as designed for the lifetime of the development. Any variation to the connections and controls indicated on the approved drawing which may be necessary at the time of construction would require the resubmission of those details to the Local Planning Authority for approval.

Reason: To ensure the approved system will function to a satisfactory minimum standard of operation and maintenance and prevent the increased risk of flooding both on and off site, in accordance with para 163 and 165 of the NPPF and its supporting technical guidance. This information is required prior to commencement of the development as the drainage arrangements may be negatively impact or inhibited by the commencement of development.
10) The building shall be occupied until the developer has formally submitted in writing to the Local Planning Authority a finalised 'Maintenance and Management Plan' for the entire surface water drainage system, inclusive of any adoption arrangements and/or private ownership or responsibilities, and that the approved surface water drainage scheme has been correctly and fully installed as per the final approved details.

Reason: To ensure that the implementation and long term operation of a sustainable drainage system (SuDS) is in line with what has been approved, in accordance with Written Statement HCWS161, 18th December 2014.
11) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
12) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
13) Prior to first occupation of the development hereby approved, details of boundary treatments shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved details.

Reason: To ensure that the appearance of the site would be acceptable in accordance with Policy BE8 of the adopted Local Plan and the NPPF.
14) The bin storage details shall be completed in accordance with drawing numbers LU5 6JH-A-03 E and SDL-033A prior to the first occupation of the development. The bin storage details shall be retained in accordance with the approved plans thereafter.

Reason: To secure a high quality development, in accordance with the NPPF.
15) All residents shall be over the age of 55.

Reason: Due to the arrangement of the units and site, and the limited amenity space, layout and car parking provision.
16) No development above ground floor level shall take place until details of the glazing and window opening to the upper floor windows within the southern elevation, serving corridor 1, are submitted to the Local Planning Authority and approved in writing. The development shall be constructed in accordance with the approved details and retained thereafter.

Reason: To safeguard the privacy of occupiers of adjoining properties, in accordance with the NPPF, Policy BE8 of the adopted Local Plan and Policy HQ1 of the emerging Local Plan.
17) Prior to the commencement of works above ground level, details of measures to address potential overheating within the development shall be submitted to the Local Planning Authority for approval in writing. The development shall be constructed in accordance with the approved details, which shall be retained thereafter.

Reason: To safeguard the amenity of occupiers, in accordance with the NPPF, Policy BE8 of the adopted Local Plan and Policy HQ1 of the emerging Local Plan.
18) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers LU5 6JH-A-03 E, LU5 6JH-A-01-B, LU5 6JH-A-02 B, LU5 6JH-A-05, P18-0598_01-C, P18-0598_02-C, LU5 6JH-A-06 and LU5 6JH-A-04.

Reason: To identify the approved plan/s and to avoid doubt.
