Conditions or Reasons for Planning Application - CB/20/02970/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Prior to the development hereby approved becoming operational, the existing A5 northbound Lay-By shall be relocated further south on the A5 with a Type B design. The mitigation scheme of relocating the existing northbound Lay-By on the A5 shall be carried out in accordance with Stuart Michael Associates Limited drawing title: 'Potential Relocation of Northbound Lay-By on the A5' drawing no. 6532.003 revision B, dated June 2020 (or subsequent versions approved in writing by the Local Planning Authority in consultation with Highways England).

Scheme details, to be submitted and approved in writing by the Local Planning Authority, shall include drawings and documents showing:
How the improvement interfaces with the exiting highway alignment and carriageway markings including lane destinations.
Full construction details relating to the highway improvement. This should include any modifications to existing structures or proposed structures, with supporting analysis.
Full signing and lighting details where applicable.
Confirmation of full compliance with departmental standards (DMRB) and policies (or approved relaxations/departures from standards).
Evidence that the scheme is fully deliverable within land in control of either the Highway Authority or the applicant.
An independent stage 2 Road Safety Audit (RSA) taking account of any stage 1 RSA recommendations, carried out in accordance with DMRB and advice notes.

Development shall proceed in accordance with the approved scheme.

Reason: To ensure that the A5 will continue to operate safely and efficiently as part of the strategic road network.

3) Prior to the development hereby approved commencing, a highway scheme to improve the site access arrangement onto the A5 shall be carried out in accordance with Stuart Michael Associates Limited drawing title: Proposed Access Arrangements, drawing no. 6532.001 revision G, dated November 2020 (or subsequent versions approved in writing by the Local Planning Authority in consultation with Highways England).

Scheme details, to be submitted and approved in writing by the Local Planning Authority, shall include drawings and documents showing:
A kerbed island and signage to prevent right turn out movements onto the A5 from the proposed site access.
The proposed realigned and improved section of existing footway along the site frontage will be of minimum 2.0m.
1.0m hard-strips would be continued along both sides of A5.
Full signing will be in place subject to acceptance and completion of any Permanent Traffic Regulation Order PTRO.
Street-lighting details where applicable.
Confirmation of full compliance with departmental standards (DMRB) and policies (or approved relaxations/departures from standards).
Evidence that the scheme is fully deliverable within land in control of either the Highway Authority or the applicant.
An independent stage 2 Road Safety Audit (RSA) taking account of any stage 1 RSA recommendations, carried out in accordance with DMRB and advice notes.

Development shall proceed in accordance with the approved scheme.

4) Prior to the development hereby approved commencing, a Construction Traffic Management Plan (CTMP) shall be submitted to and approved in writing by the Local Planning Authority in consultation with Highways England. Development shall proceed in accordance with the approved CTMP.

Reason: To ensure that the A5 will continue to operate safely and efficiently as part of the strategic road network.

5) Prior to the development hereby approved becoming operational, the turning head for service vehicles illustrated on drawing no. 6532.005 shall be constructed and shall be maintained free from obstruction in perpetuity for its intended use.

Reason: To enable service vehicles to draw off, park and turn outside the highway limits thereby avoiding the reversing of vehicles on to the highway.

6) Prior to the development hereby approved commencing, a full planting specification for the landscaping illustrated on approved plan 1-116_203.B shall be submitted to and approved in writing by the Local Planning Authority. The proposed landscaping shall be implemented by the end of the full planting season immediately following the development becoming operational (a full planting season means the period from October to March). The landscaping and trees shall subsequently be maintained and retained and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping.

6) Prior to the development hereby approved commencing, a full planting specification for the landscaping illustrated on approved plan 1-116_203.B shall be submitted to and approved in writing by the Local Planning Authority. The proposed landscaping shall be implemented by the end of the full planting season immediately following the development becoming operational (a full planting season means the period from October to March). The landscaping and trees shall subsequently be maintained and retained and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping.

7) Prior to the development hereby approved commencing, the installation and positioning of tree protection barriers shall be carried out in strict accordance with Section 6.0 "Arboricultural Guidance Notes - AGN1: Installation of Tree Protection Barriers", the "Tree Protection Plan" (Drawing No. P1681-TPP02 V3), and the "Construction Exclusion Zone Notice" (Appendix 2) which form part of the "Arboricultural Method Statement" (Document Ref No. P1681-AMS01 V3), dated 20 November 2020, as prepared by Ligna Consultancy. The tree protection barriers and CEZ Notice shall then remain securely in position throughout the entire course of development works, unless otherwise specified in the Arboricultural Method Statement.

Reason: To maintain an adequate and secure Construction Exclusion Zone around retained trees, so as to protect their root systems from damage incurred from all development works.

8) Throughout the course of development works, all working methodology and site supervision shall be carried out in accordance with the recommendations stipulated in the "Arboricultural Method Statement" (Document Ref No. P1681-AMS01 V3), dated 20 November 2020, and that required under its Appendix 3 "Schedule of Arboricultural Supervision".

Reason: To ensure full compliance of the Arboricultural Method Statement, so that the appropriate working methodology and procedures are correctly adopted in the course of all development works, in the interests of good arboricultural practice.

9) Once the development hereby approved becomes operational, monitoring of bat activity on site shall be undertaken with the results reported to the Local Planning Authority, and if necessary details submitted to and approved in writing to amend the scheme, and thereafter to proceed in accordance with the approved details.

To allow provision for amendments to be made to the scheme to prevent any detrimental impact to bats.

10) Prior to the development hereby approved becoming operational, a finalised 'Maintenance and Management Plan' for the entire surface water drainage system, inclusive of any adoption arrangements and/or private ownership or responsibilities, shall be submitted to and approved in writing by the Local Planning Authority, and shall thereafter be correctly and fully installed as per the approved details.

The final detailed design shall be based on the agreed Drainage Strategy (Ref: SMA Ref: 6532/FRA issue 1) and DEFRAs non-statutory technical standards for sustainable drainage systems (March 2018) and shall be implemented and maintained as approved. Maintenance will ensure the system functions as designed for the lifetime of the development. Any variation to the connections and controls indicated on the approved drawing which may be necessary at the time of construction would require the resubmission of those details to the Local Planning Authority for approval.

Reason: To ensure the approved system will function to a satisfactory minimum standard of operation and maintenance and prevent the increased risk of flooding both on and off site.

11) In the event that contamination is found at any time when carrying out the development hereby approved, it shall be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment shall then be undertaken by a competent person, in accordance with 'Model Procedures for the Management of Land Contamination, CLR 11'. A written report of the findings should be submitted to and approved in writing by the Local Planning Authority. Following completion of remedial measures a verification report shall be prepared that demonstrates the effectiveness of the remediation carried out. No part of the development shall operate until all remedial and validation works are approved in writing.

Reason: To provide protection from contamination risks.

12) Prior to the development hereby approved commencing, a written scheme of archaeological investigation (WSI) that includes provision for fieldwork followed by post excavation analysis and publication, shall be submitted to and approved in writing by the Local Planning Authority. The development shall then only be implemented in full accordance with the approved archaeological scheme and this condition will only be fully discharged when the post-excavation analysis and reporting is complete, and the future of the site archive is secured.

Reason: To enable the recording of and to advance the understanding of the significance of any heritage assets affected by development before they are lost (wholly or in part).

13) The development hereby permitted shall be undertaken in full accordance with the Council's adopted 'Construction Code of Practice for Developers and Contractors'. https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties.

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity.

15) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers Version 1.0 (Site Location Plan), 1-116_201.B, 1-116_202.1, 1-116_202.1.A, 1-116_202.2, 1-116_202.2.A, 1-116_202.3.A, and 1-116_203.B.

Reason: To identify the approved plans and to avoid doubt.
