Conditions or Reasons for Planning Application - CB/20/04023/FULL
Conditions or Reasons:
1) No caravan located on the site shall be occupied for residential purposes by persons other than Gypsies and Travellers, as defined in annexe 1 of Planning Policy for Traveller Sites (PPTS) 2015 stated below:

'Persons of nomadic habit of life whatever their race or origin, including such persons who on grounds only of their own or their family's or dependants' educational or health needs or old age have ceased to travel temporarily, but excluding members of an organised group of travelling showpeople or circus people travelling together as such.'

Reason: To ensure that the occupation of the residential caravans on the site is restricted to Gypsies and Travellers in recognition of the location of the site in the Green Belt.

2) The occupation of the caravans located on the site shall be limited to the following persons and their dependant relatives:

Johnny Connors, Jerry Connors and Margaret Connors, and Bridget Donahue.

Reason: In recognition of the location of the site in the Green Belt and the 'very special circumstances' case.

3) The development hereby approved shall be laid out as one pitch and thereafter retained as shown on approved plan number BP-01-2021, whereby only a maximum of three static caravans and one touring caravan shall occupy the pitch for residential purposes.

Reason: In recognition of the protection of the amenities of the occupiers of the site and in recognition of the location of the site in the Green Belt.

4) In the event that the site shall cease to be occupied by those named in Condition 2, the use of pitch 32d shall cease and all caravans shall be removed from the site within 28 days of that date.

Reason: In recognition of the location of the site in the Green Belt and the 'very special circumstances' case.

5) No commercial activity shall take place on the site, including the storage of materials.

Reason: To ensure that the development has no unacceptable adverse effect upon general or residential amenity and having particular regard to the location of the site in the Green Belt.

6) No commercial vehicles over 3.5 tonnes shall be stationed, parked or stored on any part of the site.

Reason: To ensure that the development has no unacceptable adverse effect upon general or residential amenity and having particular regard to the location of the site in the Green Belt.

7) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) or any Order or enactment amending or re-enacting that Order, no ancillary buildings or other structures, walls, fences, gates or other means of enclosure, shall be erected on the site other than in accordance with such amendment to the approved drawings as may be agreed in writing by the Local Planning Authority or in accordance with a specific grant of planning consent in that regard.

Reason: To ensure that the development has no unacceptable adverse effect upon general or residential amenity and having particular regard to the location of the site in the Green Belt.

8) Within three months of the date of this decision, details of the provision of a new cess pit or alternative means of foul drainage provision and of a suitable size for the likely occupation of the site shall be submitted to and approved in writing by the Local Planning Authority and installed in accordance with the approved details within a further 3 months from approval. A programme of management and maintenance of the approved foul drainage system for the lifetime of the development shall also be submitted to the Local Planning Authority within three months of the date of this decision and approved in writing by the Local Planning Authority. The drainage system shall be managed and maintained in accordance with the approved programme.

Reason: To ensure protection of the water environment.

9) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers LP-01-2020, BP-01-2021 and DR-01-2021.

Reason: To identify the approved plans and to avoid doubt.
