Conditions or Reasons for Planning Application - CB/21/02631/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) No development shall take place until a landscaping scheme to include all hard and soft landscaping and a scheme for landscape maintenance for a period of five years following the implementation of the landscaping scheme have been submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping.
(Sections 12 & 15, NPPF)
3) The submitted tree protection details as shown on plan no. 554-111A and supporting document Tree Survey Report dated May 2021 shall adhered to throughout the whole development.

Reason: To ensure no unacceptable impact upon the on site trees to be retained.
4) No development shall take place until an Ecological Enhancement Strategy (EES) for the creation of new wildlife features such as hibernacula, the inclusion of integrated bird/bat and bee boxes in buildings/structures, hedgehog holes in fences and tree, hedgerow, shrub and wildflower planting/establishment has been submitted to and approved in writing by the local planning authority. The content shall be informed by the June 2021 Protected Species Report and include the:
a) purpose and objectives for the proposed works;
b) detailed design(s) and/or working method(s) necessary to achieve stated objectives (including, where relevant, type and source of materials to be used);
c) extent and location of proposed works shown on appropriate scale maps and plans;
d) timetable for implementation, demonstrating that works are aligned with the proposed phasing of construction;
e) persons responsible for implementing the works;
f) details of initial aftercare and long-term maintenance.
The works shall be carried out strictly in accordance with the approved details and shall be retained in that manner thereafter

Reason: To ensure development is ecologically sensitive and secures biodiversity enhancements in accordance with the National Planning Policy Framework.
5) Prior to the development being brought into use, the proposed development shall be carried out and completed in all respects in accordance with the access siting and layout, surfacing, on site turning area, and parking provision and layout illustrated on the approved plan No. 554-110A and defined by this permission and, notwithstanding the provision of the Town and Country Planning General Permitted Development Order 1995, (or any Order revoking or re-enacting that Order) there shall be no variation without the prior approval in writing of the Local Planning Authority.

Reason: To ensure that the development of the site is completed insofar as its various parts are interrelated and dependent one upon another and to provide adequate and appropriate access, turning and parking provision at all times.
6) No development shall commence until a Construction Management Plan (CMP) has been submitted to and approved in writing by the Local Planning Authority. The CMP shall include details of: Construction Activities and Timing; Plant and Equipment, including loading and unloading and the siting of the crane; Construction traffic routes and points of access/egress to be used by construction vehicles; Provision for construction worker, contractor vehicle and school staff parking Details of site compounds, offices and areas to be used for the storage of materials; Details of on-site wheel cleaning facilities; Dust mitigation and suppression measures; Contact details for site managers and details of management lines of reporting to be updated as different phases come forward; Details for the monitoring and review of the construction process including traffic management and details of temporary Traffic Regulation Order (TRO) during construction (to include a review process of the CMP during development).
The development shall then be carried out in accordance with the approved CMP.

Reason: Details are required prior to the commencement of development, in the interest of highway safety and to ensure a satisfactory standard of construction and layout for the development and to comply with HQ1 of the Central Bedfordshire Local Plan.
7) Details of a 3.0m widened footpath within the school grounds taking access from Yew Tree Walk, including widened gate, surfacing and low level lighting shall be submitted to and approved in writing to the local planning authority and the approved details implemented prior to the development being brought into use

Reason: To provide a more accessible access for ease of use for pupils and cyclists and to promote sustainable means of transport
8) Prior to development details of a scheme of the following highway improvements shall be submitted to and approved in writing by the local planning authority and the approved scheme of highway improvements implemented prior to the development being brought into use:
Relocate 1 x existing school sign from Church Street nearer to the junction with Broad Street, and provide 1 new school sign north of the Golden Lion Public House with the junction of Church Street
2 x new signs either end of the 'school keep clear marking' on Church Street in accordance with the order (no stopping on entrance markings, Monday to Friday 8am 4.30pm)
Waiting restrictions on Church Street (between the junctions with Church Street and Broad Street) to prevent waiting on the school side of the road at the start and end of the school day
Waiting restrictions at the junctions of Church Street with Church Street, Church Street with Broad Street and Broad Street with Newis Crescent to prevent waiting at any time.
Junction narrowing and informal pedestrian crossing of dropped kerbs/tactile paving added at the junctions of Church Street with Church Street and Church Street with Broad Street.
H bars provided at the rear accesses at Miles Drive where the properties front Yew Tree Walk and there is a 'parking area' to the rear

Reason: In the interest of road safety and pedestrian movement and to avoid obstruction of existing accesses and to comply with Policy T2 of the Central
Bedfordshire Local Plan.
9) No development shall commence until a detailed surface water drainage scheme, to manage surface water runoff from the development for up to and including the 1 in 100 year event (+40%CC), and approved in writing by the Local Planning Authority. The discharge from the development will be via soakaway. The final detailed design shall be based on the agreed FRA & Drainage Strategy (Ref: PCMS, ) and DEFRAs Non-statutory technical standards for sustainable drainage systems (March 2018) and shall be implemented and maintained as approved. Maintenance will ensure the system functions as designed for the lifetime of the development. Any variation to the connections and controls indicated on the approved drawing which may be necessary at the time of construction would require the resubmission of those details to the Local Planning Authority for approval.

Reason: To ensure the approved system will function to a satisfactory minimum standard of operation and maintenance and prevent the increased risk of flooding both on and off site, in accordance with para 163 and 165 of the NPPF and its supporting technical guidance.
10) Before the building is first brought into use, an updated Travel Plan shall be prepared, submitted and approved by the Local Planning Authority. The plan shall contain details of:
plans for the establishment of a working group involving the School, parents and representatives of the local community
pupil travel patterns and barriers to sustainable travel
measures to encourage and promote sustainable travel and transport for journeys to and from school
an action plan detailing targets
a timetable for implementing appropriate measures and plans for annual monitoring and review
measures to manage the car parking on site
All measures agreed therein shall be undertaken in accordance with the approved Plan. There shall be an annual review of the Travel Plan (for a period of 5 years from the date of approval) to monitor progress in meeting the targets for reducing car journeys generated by the proposal and this shall be submitted to and approved by the Local Planning Authority.
Reason: In the interests of highway safety, to reduce congestion and to promote the use of sustainable modes of transport.
11) The scheme for the provision of electric charging points for vehicles as displayed on plan no. 554-110 A shall be implemented prior to the first use of the approved development.

To accord with paragraph 110 of the NPPF and Policy T5 of the Local Plan.
12) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
13) The temporary Modular building shall only be used as a School Classroom and shall be retained on the site for a limited period no longer than 3 years commencing from the date of this decision notice, and at the end of which period it shall be completely removed from the site within a period of 3 months.

Reason: This is a temporary building to be used while the main extension if being constructed and is therefore only should be granted temporary permission.
14) The southern elevation window(s) of the modular classroom building hereby permitted shall be permanently fitted with obscured glass of a type to substantially restrict vision through it at all times and shall be non-opening. No further windows or other openings shall be formed in the southern elevation.

Reason: To safeguard the privacy of occupiers of adjoining properties (Section 12, NPPF)
15) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers J6/01053 Sheet 1, 21-0548-001, BXMW-SJ-1.04 Rev C, unv/SOF/4100/std/100 [C], BXMW/GS4/S/800-3.00(A) , 554-111A, 554-110A, 554-108A, 554-107A, 554-106A, 554-105A, 554-104A, 554-103A, 554-109A, 554-102A, 554-101A, 544-100A.

Reason: To identify the approved plan/s and to avoid doubt.
