Conditions or Reasons for Planning Application - CB/21/03272/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) All external works hereby permitted to the outbuilding at the rear of the site shall be carried out in accordance with the approved details as shown on plan titled Proposed Elevations. The replacement doors and windows for the HMO unit hereby approved shall be constructed in either in painted white timber or uPVC white timber effect in the same style as the existing windows on site.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match the existing building in the interests of the visual amenities of the locality and to preserve the character of the Conservation Area. (Section 12 and 16, NPPF)
3) No development to the retail unit fronting High Street North shall take place, until the colour of the aluminium frame hereby approved has been submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be carried out in accordance with the approved details.

Reason: To control the appearance of the building in the interests of the visual amenities of the conservation area.

4) Notwithstanding the changes of use permitted within Part 3 of Schedule 2 of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification), the conversion and extension of the outbuilding hereby approved shall only be used as a retail unit within Class E(a) of the Town and Country Planning (Use Classes) Order 2020 (or any Order revoking or re-enacting that Order with or without modification) only, and for no other purpose.

Reason: To exclude the provisions of the said Use Classes Order and thereby ensure the Local Planning Authority retains full control of the future use of the building(s) in view of the special circumstances of the case.

5) The cycle parking scheme, as shown on the approved drawing, shall be fully implemented before the development is first brought into use and thereafter retained for this purpose.

Reason
To ensure the provision of adequate cycle parking to meet the needs of occupiers of the proposed development in the interests of encouraging the use of sustainable modes of transport.
6) No development shall take place until a scheme for protecting the proposed dwellings from noise from road traffic has been submitted to and approved in writing by the local planning authority. None of the dwellings shall be occupied until such a scheme has been implemented in accordance with the approved details and it shall be retained in accordance with those details thereafter.

Reason: To provide an acceptable level of amenity to occupiers of the HMO
7) All ground floor windows shall be fixed so as not to open outwards into the public highway.

Reason: In the interest of pedestrian/highway safety and convenience. (Section 9 and 12 NPPF).
8) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
9) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, Existing Elevations, Existing Floor Plans, Existing Site Location Plan and Proposed Block Plan, Existing Street Elevations and Cross Section, Proposed Elevations, Proposed HMO Floor Plans Rev B and Proposed Street Elevations and Cross Section.

Reason: To identify the approved plan/s and to avoid doubt.
10) Prior to the occupation of any uses on the site, the waste receptacles for the scheme shall be provided and stored as shown on the approved plans. The waste receptacles for both the residential and retail uses shall be stored within the area shown on the plans at all times with exception on collection day.

Reason: In the interest of residential and public amenity (Policy HQ1)
