Conditions or Reasons for Planning Application - CB/21/04832/REG3
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development hereby approved shall be constructed in the materials as shown on the approved plans unless agreed in writing by the Local Planning Authority.

Reason
To control the appearance of the building in the interests of the visual amenities of the locality. (Section 12, NPPF)
3) Before the development is brought into use the additional 3 on site parking bays shall be implemented and surfaced in accordance with the approved plan no. DR-L-2002-P9. Thereafter, all on site parking provision shall not be used for any purpose, other than as parking provision unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason
For the avoidance of doubt, to provide adequate on site parking provision, to retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users and to avoid obstruction of manoeuvring vehicles within the site.
4) Prior to the development being brought into use the highway works indicated and annotated on the approved plans no. DR1 and DR2 shall be implemented.

Reason
To provide enhanced pedestrian access, and alleviating obstruction of the junction and school entrance by parked vehicles
5) Notwithstanding the details submitted, annotated details of the signage and road markings to formalise the one way arrangement through the school car park and accesses shall be submitted to and approved in writing by the local planning authority and the approved details shall be implemented prior to the development being brought into use and thereafter retained

Reason
For the avoidance of doubt and to alleviate congestion at the accesses
6) Details of the following highway works/schemes shall be submitted to and approved in writing by the local planning authority and the approved works/schemes shall be implemented prior to the development being brought into use:

a) no stopping restriction to coincide with the start and end of the school day opposite the existing school keep clear marking on Weathercock Close to denote an area outside the school that should be kept clear of parked vehicles
b) Tactile paving at the footpath adjacent to 31a Station Road to 74 Weathercock Lane at Weathercock Lane
c) An informal pedestrian dropped crossing with tactile paving located north of the 20mph roundel on Weathercock Lane at the Weathercock pub and opposite at no. 53 Station Road
d) Tactile paving and a H bar at the informal pedestrian crossing adjacent to no.6 Burrows Close and opposite
e) Protect informal pedestrian crossing points with no parking restrictions (H bars) to enable pedestrians to cross unhindered

In the event that the TROs required for the above works are not progressed, the applicant shall submit in writing a revised scheme to manage parking to the local planning authority (and thereafter implemented in accordance with the approved plans).

Reason
To enhance and provide a safe pedestrian access to the school and to alleviate obstruction of the carriageway at peak school times
7) Before the building is first brought into use, an updated Travel Plan shall be prepared, submitted and approved by the Local Planning Authority. The plan shall contain details of:
a. plans for the establishment of a working group involving the school, parents and representatives of the local community
b. pupil travel patterns and barriers to sustainable travel
c. measures to encourage and promote sustainable travel and transport for journeys to and from school
d. an action plan detailing targets
e. a timetable for implementing appropriate measures and plans for annual monitoring and review
f. measures to manage the car parking on site
g. discussions (and if applicable an agreement) with Fulbrook School over staggered pupil start and finish times

All measures agreed therein shall be undertaken in accordance with the approved Plan. There shall be an annual review of the Travel Plan (for a period of 5 years from the date of approval) to monitor progress in meeting the targets for reducing car journeys generated by the proposal and this shall be submitted to and approved by the Local Planning Authority.

Reason:
In the interests of highway safety, to reduce congestion and to promote the use of sustainable modes of transport.
8) The landscaping scheme and management plan hereby approved shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason
To ensure an acceptable standard of landscaping. (Sections 12 & 15, NPPF)
9) All ecological measures and/or works shall be carried out in accordance with the details contained in the October 2021 Preliminary Ecological Appraisal and December 2021 PEA Update as already submitted with the planning application and agreed in principle with the local planning authority prior to determination.

Reason: To ensure that no protected species are harmed/impacted.
10) No development shall take place until an Ecological Enhancement Strategy (EES) for the creation of new wildlife features such as hibernacula, the inclusion of integrated bird/bat and bee boxes in buildings/structures, hedgehog holes in fences and tree, hedgerow, shrub and wildflower planting/establishment has been submitted to and approved in writing by the local planning authority. The content shall include the:

a) purpose and objectives for the proposed works;
b) detailed design(s) and/or working method(s) necessary to achieve stated objectives (including, where relevant, type and source of materials to be used);
c) extent and location of proposed works shown on appropriate scale maps and plans;
d) timetable for implementation, demonstrating that works are aligned with the proposed phasing of construction;
e) persons responsible for implementing the works;
f) details of initial aftercare and long-term maintenance.

The works shall be carried out strictly in accordance with the approved details and shall be retained in that manner thereafter.

Reason: To ensure development is ecologically sensitive and secures biodiversity enhancements in accordance with the National Planning Policy Framework.
11) Prior to development, all tree protection fencing shall be constructed, installed, positioned and supervised in strict accordance with the submitted Arboricultural Impact Assessment by agb Environmental including Appendix 5 "Tree Protection Plan" and Appendix 6 "Tree Protection Fencing Specification". The tree protection fencing shall then remain securely in position throughout the entire course of development works.

REASON
To protect retained trees and hedging from damage incurred as a result of any development activity, so as to maintain their health, anchorage, screening and amenity value.
12) Details of the electric charging points and passive charging points shall be submitted to and approved in writing by the local planning authority after which the approved details shall be implemented before the development is brought into use

Reason
For the avoidance of doubt and to provide charging for electric vehicles
13) No development shall take place, including any works of demolition, until a Construction Traffic Management Plan, associated with the development of the site, has been submitted and approved in writing by the Local Planning Authority which will include information on:

(A) The parking of vehicles associated with the construction within the site and where displaced staff parking will be located
(B) Loading and unloading of plant and materials used in the development
(C) Storage of plant and materials used in the development
(D) The erection and maintenance of security hoarding / scaffolding affecting the highway if required.
(E) Wheel washing facilities
(F) Measures on site to control the deposition of dirt / mud on surrounding roads during the development.
(G) Footpath/footway/cycleway or road closures needed during the development period
(H) Traffic management needed during the development period.
(I) Temporary relocation of the internal footways within the site during the construction period and/or relocation of the pedestrian access into/from the school which will be closed when the construction period is complete
(J) Deliveries outside of peak school start/finish times
The approved Construction Management Plan associated with the development of the site shall be adhered to throughout the development process.

Reason:
In the interests of safety, protecting the amenity of local land uses, neighbouring residents and highway safety.

Reason: To identify the approved plan/s and to avoid doubt.
15) The development hereby permitted shall not be brought into use until the cycle parking on the site as shown on the approved plans has been fully implemented. The cycle parking shall be retained for this purpose thereafter.

Reason: To ensure the provision of cycle parking to meet the needs of occupiers of the proposed development in the interests of encouraging the use of sustainable modes of transport.
