Conditions or Reasons for Planning Application - CB/21/05100/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Details of any new materials to be used for the external walls, roof, windows and doors of the development hereby approved shall be submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be carried out only in accordance with the approved details.

Reason: To control the appearance of the building in the interests of the visual amenities of the locality and character of the existing building. (Section 12 and 16 NPPF).
3) All ecological measures and/or works shall be carried out in accordance with the details contained in chapter 6 of the approved November 2020 Ecological Appraisal.
Reason: To ensure protection of existing habitats. (Section 15, NPPF)
4) All tree work shall be carried out in strict compliance with that specified in Section 5.1 'Tree Work' of the 'Arboricultural Implications Assessment', (Document Ref. 4140.Goose_Lodge.DLP.AIA.Rev A), and as specified in the 'Tree Protection and Method Statement' that forms part of the 'Tree Protection Plan' (Drawing No. 4140.GooseLodge.DLP.TPP Rev A).

Reason: To ensure that only the required tree work to facilitate access for development, or that identified for safety reasons, is undertaken, thereby avoiding excessive, unnecessary and unjustified tree work being carried out, which would have an adverse impact on the setting of the Conservation Area, and be contrary to Section 211 of the Town and Country Planning Act 1990 (Section 12 NPPF).
5) Following the permitted access facilitation pruning, all tree protection barriers and ground protection shall be installed and positioned in strict accordance with the 'Tree Protection and Method Statement', and the 'Tree Protection Plan' (Drawing No. 4140.GooseLodge.DLP.TPP Rev A), dated 14th January 2022, as prepared by Andrew Belson (Arboricultural Consultant). The tree protection barriers and ground protection shall then remain securely in position throughout the entire course of development works.

Reason: To protect the designated Root Protection Area of retained trees from development damage, so as to secure their health, anchorage and amenity value. (Section 12 NPPF)
6) Throughout the course of development works, all general construction operations, including the installation of services, shall be carried out in strict accordance with that stipulated in the 'Tree Protection and Method Statement', that forms part of the 'Tree Protection Plan' (Drawing No. 4140.GooseLodge.DLP.TPP Rev A), dated 14th January 2022, as prepared by Andrew Belson (Arboricultural Consultant).

Reason: To ensure that all working practices are carried out in accordance with good arboricultural practice, so as to avoid damage and thereby maintain tree health, anchorage and amenity value.(Section 12 NPPF)
7) Details of the widening of the proposed vehicular access with the highway to create an access width of 4.8m for the first 8m measured into the site from the edge of carriageway shall be submitted to and approved by the Local Planning Authority and the dwelling shall not be occupied until the junction has been constructed in accordance with the approved details.

Reason:In order to minimise danger, obstruction and inconvenience to users of the highway and the premises. (Section 9 NPPF)
8) The vehicular access/driveway shall be surfaced in bituminous or other similar durable material (not loose aggregate) as may be approved in writing by the Local Planning Authority for a distance of 5m into the site, measured from the highway boundary, before the new premises are occupied. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of highway safety.(Section 9 NPPF)
9) Visibility splays shall be provided at the junction of the access with the public highway before the new development is brought into use. The minimum dimensions to provide the required splay lines shall be 2.4m, measured along the centre line of the access from its junction with the channel of the public highway and 43m measured in a northerly direction and 60m in a southerly direction, from the centre line of the vehicle access along the line of the channel of the public highway. The required vision splays shall for the perpetuity of the development remain free of any overhanging vegetation on the public highway.

Reason: To provide adequate visibility between the existing highway and the proposed access, and to make the access safe and convenient for the traffic which is likely to use it.

10) Any gates provided shall open away from the highway and be set back a minimum distance of at 8.0m from the nearside edge of the carriageway of the adjoining highway.

Reason: To enable vehicles to draw off the highway before the gates are opened. (Section 9 NPPF).
11) Details of a pedestrian footway link between the two off-street parking spaces retained for Goose Lodge and the south eastern corner of Goose Lodge shall be submitted to and approved by the Local Planning Authority. The footway link shall be constructed in accordance with the approved details prior to occupation of the new dwelling and retained in perpetuity for the benefit of the residents of Goose Lodge.

Reason: To ensure the provision of pedestrian access for users of Goose Lodge to the car parking area. (Section 9 NPPF)
12) The two parking bays shown as 'Parking reinstated' on plan PL04 shall be kept in an open condition and fully available for the sole use of residents of Goose Lodge and retained in perpetuity for that use

Reason: To ensure the permanent availability of car parking spaces for residents, clear of the public highway.(Section 9 NPPF)
13) Details of a turning area, complete with tracking diagrams, for a light goods service vehicle (6.25m length, 2.14m in width) within the curtilage of the development shall be submitted to and approved in writing by the Local Planning Authority. The turning area shall be constructed in accordance with the approved details before the new development is occupied and retained in perpetuity.

Reason: To enable service vehicles to draw off, park and turn outside of the highway limits thereby avoiding the reversing of vehicles on to the highway.(Section 9 NPPF)
14) Notwithstanding the provisions of Part 1, Classes A - F of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no further development shall be carried out without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the external appearance of the site and building in the interests of the rural amenity of the area and Conservation setting.

15) A scheme shall be submitted for approval in writing by the Local Planning Authority indicating the positions, design, materials and type of boundary treatment to be erected. The boundary treatment shall be completed in accordance with the approved scheme before the building is occupied and be thereafter retained.

Reason: To safeguard the appearance of the completed development and the visual amenities of the locality.(Section 12 and 16, NPPF)
16) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers PL00A, PL01A, PL02, PL03A, PL04A, PL05, AIP Rev A, TPP Rev A, Arboricultural Impact Assessment 14 Jan 22, Bat roost assessment Jan 22, Ecological Appraisal Nov 21, Rawlings Visual Inspection Jan 21, Agents structural clarification email 01 Dec 21, Design and Access Statement Oct 21.

Reason: To identify the approved plan/s and to avoid doubt.
