Conditions or Reasons for Planning Application - CB/21/05683/FULL
Conditions or Reasons:
1) No building shall be occupied until the junction of the proposed vehicular access with the highway has been constructed in accordance with the details shown on drawing number TM/HF/001 rev B.
Reason In order to minimise danger, obstruction and inconvenience to users of the highway and the premises.
2) No dwelling shall be occupied until, in accordance with drawing no. TM/HF/001, a 2.0m wide verge has been provided on the east side of Pipers Lane along the entire frontage of the land and up to the public footpath, the verge works shall include the installation of edging panels or boundary markers to delineate the highway boundary and the dedication of land as highway if necessary.

Reason: In the interests of road safety and pedestrian movement. (Section 9, NPPF)
3) Visibility splays shall be provided at the junction of the access with the public highway before the development is brought into use. The minimum dimensions to provide the required splay lines shall be 2.4m measured along the centre line of the proposed access from its junction with the channel of the public highway and 43m measured either side from the centre line of the proposed access along the line of the channel of the public highway. The required vision splays shall, on land in the applicant's control, be kept free of any obstruction in excess of 0.6m in height above the nearside channel level.

Reason: To provide adequate visibility between the existing highway and the proposed access, and to make the access safe and convenient for the traffic which is likely to use it. (Section 9, NPPF)
4) The proposed private shared access driveway shall be surfaced in accordance with the approved drawing before the premises are occupied. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of highway safety. (Section 9, NPPF)
5) The turning space for service vehicles illustrated on the approved plan shall be constructed before the development is first brought into use and shall be kept clear from obstruction in perpetuity for its intended use.

Reason: To enable vehicles to draw off, park and turn outside the highway limits thereby avoiding the reversing of vehicles on to the highway. (Section 9, NPPF)
6) Before the development is first occupied or brought into use, the parking scheme shown on the approved drawing shall be completed and thereafter retained for this purpose.

Reason: To ensure the provision of car parking clear of the highway. (Section 9, NPPF)
7) No building shall be occupied until the refuse collection point has been constructed in accordance with the approved details on drawing number TM/HF/001 rev B.

Reason In the interest of amenity and in order to minimise danger, obstruction and inconvenience to users of the highway and the premises. (Section 9, NPPF)
8) The parking bay shown as visitor parking on the approved plan shall be kept as unassigned parking and in an open condition, fully available for this purpose and no bollard, barrier or similar device or designation signs shall be erected thereon.

Reason To ensure the permanent availability for off-street car parking for visitors.
9) Notwithstanding the provisions of Part 1, Class A of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no extensions to the dwelling hereby permitted shall be carried out without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the external appearance of the development and for the protection of the visual amenities and openness of the Green Belt. (Sections 12 and 13, NPPF)
10) Notwithstanding the provisions of Part 1 Class E of Schedule 2 to the Town and Country (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no buildings or other structures shall be erected or constructed within the curtilage of and of the dwelling without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the external appearance of the development and for the protection of the visual amenities and openness of the Green Belt. (Sections 12 and 13, NPPF)
12) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 2021-1002-33D - Block Plan, 2021-1002-31 - Plot 1 Floor Plans and Elevations, 2021-1002-32 - Plot 2 Floor Plans and Elevations, Tree Constraints and Tree Protection Plan Revision A, Site Location Plan A4 1.1250, TM/HF/001 Highways Considerations Rev B, Landscape Planting Scheme Revision B?

Reason: To identify the approved plan/s and to avoid doubt.
13) Tthe required tree protection barriers and ground protection shall be installed and positioned in strict accordance with Section 4.0 "Arboricultural Method Statement", Section 5 "Installation of Tree Protection", and Appendix 1 "Tree Protection Plan -Revision A" of the supporting document "Tree Protection Plan and Arboricultural Method Statement", dated November 2022. The tree protection barriers and ground protection shall then remain securely in position throughout the entire course of development works.

Reason: To secure the protection of retained Ash trees numbered T1, T2 , T3 and T4, and hedgerow G1, as marked on the tree survey drawings, from encroachment into their designated Root Protection Areas, which may be caused by development activity. (Section 12, NPPF)
14) Throughout the course of development works, all working practices shall conform to the requirements and working methodology set out in Section 4.0 "Arboricultural Method Statement" of the supporting document " Tree Protection Plan and Arboricultural Method Statement", dated November 2022.

Reason: To ensure that all development activity is carried out in accordance with the requirements of good arboricultural practice, so as to avoid damage to retained trees and hedging that may be incurred as a result of potentially harmful development activity. (Section 12, NPPF)
15) The landscaping scheme and maintenance specification as identified in the Landscape Works and Planting with Maintenance Specification (Rev B) and drawing Proposed Landscaping Revision B shall be implemented in the first planting season (November to March) following completion of the development, and shall be maintained for a period of 5 years until satisfactorily established, with any losses replaced in accordance with the approved plans and specification.

Reason: To ensure the satisfactory planting, aftercase and establishment of landscape planting in the interests of visual amenity. (Section 12, NPPF)
16) The boundary treatment as shown on the Block Plan (dwg. no. 2021/1002/33D) shall be implemented before the dwellings are occupied and thereafter retained.

Reason: To safeguard the appearance of the development and the visual amenities of the local area. (Section 12, NPPF)
17) The EV charging points as identified on the Block Plan (dwg. no. 2021/1002/33D) shall be implemented in accordance with the approved details and available for use prior to occupation of the dwellings.

Reason: To assist with the transition to low-emission vehicles in line with Policy T5 of the Central Bedfordshire Local Plan and the NPPF.
18) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
