Conditions or Reasons for Planning Application - CB/22/03121/VOC
Conditions or Reasons:
1) The long term monitoring and maintenance plan set out within the RPS letter dated 02/08/2013 as submitted and approved under Condition 5 of CB/13/04399/VOC shall be implemented in accordance with the approved details.

Reason: To protect the quality of controlled waters in accordance with the Environment Agency's Groundwater Protection: Policy and Practice (GP3) document in accordance with the principles of the National Planning Policy Framework.
2) All deliveries to the site shall be undertaken strictly in accordance with the approved delivery methodology (Service Yard Management Plan prepared by Vectos and approved under Condition 8 of CB/13/04399/VOC) unless otherwise agreed in writing with the Local Planning Authority.

Reason: To safeguard the amenities of occupiers of adjoining properties and in accordance with Policy CC8, HQ1, T1 and T6 of the Central Bedfordshire Local Plan.
3) The noise from fixed plant, equipment and machinery on units A to H which form the Northern Retail Terrace shall not exceed a level of 5dBA below the existing background level (or 10dBA below if there is a tonal quality or distinguishable characteristics) when measured or calculated according to BS4142:1997 the agreed distance, in full accordance with the approved details under Condition 9 of CB/14/01181/VOC, unless otherwise agreed in writing with the Local Planning Authority.

Reason: To safeguard the amenities of adjoining properties and in accordance with Policy CC8 and HQ1 of the Central Bedfordshire Local Plan.
4) No moveable power driven machinery/plant and/or equipment shall be operated in the service yards serving the Northern Retail Terrace / Retail Units A H outside the delivery hours defined in the Service Yard Management Plan approved pursuant to Condition 2 above, without the prior consent, in writing of the Local planning Authority.

Reason: To safeguard the amenities of adjoining properties and in accordance with Policy CC8 and HQ1 of the Central Bedfordshire Local Plan.
5) The 3.6 metre acoustic barrier, erected along the Northern Boundary of the development site and erected in full accordance with 8659-P90-B - "Proposed Acoustic Fence & Acoustic Panels", J7/01047 - "Detail of Jakoustic Highway Fencing System - With Capping Option", H16881-C-1-701-C1 - "Acoustic Fence Foundation Layout", H16881-C-1-702-C1 - "Acoustic Fence Section", 11-19-38-Rev-B - "Tree Pit Details", Sound Absorption Absorptive Timber Noise Barrier Test Certificate, Sound Insulation Absorptive Timber Noise Barrier Test Certificate, Sound Insulation Reflective Timber Noise Barrier Test Certificate, Jakcure Timber Treatment - Technical & Safety Information as submitted and approved on 18/07/2014 under Condition 11 of CB/14/01109/VOC, shall be retained and maintained in perpetuity.
Reason: To safeguard the amenities of adjoining properties.
6) Gate details to prohibit vehicle access to the service yard to the rear of Units A to H outside of the agreed permitted delivery hours at the site shall be in accordance with the approved details (8659-PH1-E23, 8659-PH1-P91-C, 8659-PH1-P92-E, 8659-PH1-P93-D as approved under Condition 12 of CB/14/01109/VOC).

Reason: For the avoidance of doubt and in the interests of residential amenity in accordance with Policy HQ1 and CC8 of the Central Bedfordshire Local Plan.
7) The development shall be carried out in accordance with the approved Travel Plan for the site (Framework Travel Plan dated July 2015 - Vectos and approved under Condition 16 of CB/14/01109/VOC) unless otherwise agreed in writing by the Local Planning Authority.

The development, hereby approved, shall only be used in accordance with the approved travel plan and the timetable agreed within to implement measures to minimise private car use and incentives to encourage walking, cycling and to promote travel choice.

Reason: In the interests of sustainable travel.
8) The development shall be carried out in accordance with the approved waste management details (Waste Management Strategy) unless otherwise agreed beforehand in writing by the Local Planning Authority.

Reason: To ensure no open storage of rubbish on the site and to protect the character and appearance of the surrounding area in accordance with Policy HQ1 of the Central Bedfordshire Local Plan.
9) The development hereby approved for the units referred to as A, B, D, F,G, H, J, K, L, M, N, P, Homebase, Unit 1 and Unit 2 as shown on plan no. 8659 P02 Revision W shall be used for A1 (retail) but shall not be used for the sale of food, as a post office, for the sale of tickets, as a travel agency, for hairdressing, for the direction of funerals, for the reception of goods to be washed, cleaned or repaired, as an internet café where the primary purpose of the premises is to provide facilities for enabling members of the public to access the internet or as a pharmacy, except for Unit B which can be in part used as a pharmacy and can sell food in up to 5% of its total ground floor area.

Reason: To define this permission and to ensure that the Local Planning Authority retain planning control over the retail functions of the site.
10) The development hereby approved for the unit referred to as Unit E as shown on plan no. 8659 P02 Revision W shall be used for A1 (retail) but shall only have a maximum of 226 sqm of its floor area for the sale of food, and Unit E shall not be used as a post office, for the sale of tickets, as a travel agency, for hairdressing, for the direction of funerals, for the reception of goods to be washed, cleaned or repaired, as an internet café where the primary purpose of the premises is to provide facilities for enabling members of the public to access the internet or as a pharmacy.

Reason: To define this permission and to ensure that the Local Planning Authority retain planning control over the retail functions of the site.
11) The development hereby approved for unit C as shown on plan no. 8659 P02 Revision W shall be used for A1 (retail) and up to a maximum of 975 sq m of A1 (food) but shall not be used as a post office, for the sale of tickets, as a travel agency, for hairdressing, for the direction of funerals, for the reception of goods to be washed, cleaned or repaired, as an internet café where the primary purpose of the premises is to provide facilities for enabling members of the public to access the internet or as a pharmacy.

Reason: To define this permission and to ensure that the Local Planning Authority retain planning control over the retail functions of the site.
12) No unit as defined by plan no. 8659 P02 Revision W shall be sub divided to provide a unit of less than 500 sqm (5,382 sq ft) without the express written consent of the Local Planning Authority.

Reason: To ensure the vitality and vibrancy of the existing Town Centre, for the avoidance of doubt, and in accordance with the intentions contained within the National Planning Policy Framework.
13) The development shall be carried out in accordance with the approved Service Yard Management Plan (Service Yard Management Plan prepared by Vectos) unless otherwise agreed beforehand in writing by the Local Planning Authority.

Reason: To protect living conditions at neighbouring properties.
14) The installed way-finding board (8659 563 B) board shall be displayed as approved and shall be permanently retained unless otherwise agreed beforehand in writing by the Local Planning Authority.

Reason: To allow visitors an understanding of the site and of sustainable transport methods to and from it.
15) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the previously approved plans, numbers CBC001 (Tree Constraints Plan Rev A August 2011 Drawing Sheet 01); CBC002 (Tree Constraints Plan Rev A August 2011 Drawing Sheet 02); CBC003 (Tree Constraints Plan Rev A August 2011 Drawing Sheet 03); 110083-A-03 Rev A; 11-09-04 Rev E;8659-E02 K; 8659 E03 C; 8659 P01 A; 8659 P02 W, 8659 P03 E; 8659 P04 D; 8659 P05 P; 8659 P06 G; 8659 P08 C; 8659 P13; 8659 P14; 8659 P20 G; 8659 E05 B; 8659 E06; 8659 E07; 8659 S01 H; 8659 S02 C, 8659 S E14 D, 8659 S16 D, H-P02-A, 8659-S-P04-F, 8659-S-P06-B, AT/A01, AT/A02, AT/A03, AT/A04, and Design and Access Statement dated January 2014; and the amendments to planning permission CB/14/01181/VOC via Section 96a of the Town and Country Planning Act 1990 (as amended), including those approved under references: CB/15/04394/NMA, CB/15/03862/NMA, CB/15/03659/NMA. CB/15/03190/NMA, CB/15/02399/NMA. CB/15/02403/NMA and CB/15/00714/NMA.
