Conditions or Reasons for Planning Application - CB/22/04514/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers SIS025 01, SIS025 02, SIS025 03, SIS025 04, SIS025 05, SIS025 06, SIS025 07, SIS025 08 and SIS025 09

Reason: To identify the approved plan/s and to avoid doubt.
3) Construction of the facility hereby permitted shall be carried out in full accordance with the details set out in the document title 'Stratton Upper School Construction Management Plan (CMP)' prepared by SIS Pitches and dated January 2023, unless otherwise agreed in writing beforehand by the Local Planning Authority.

Reason: In the interests of safety, protecting the amenity of local land uses, neighbouring residents and highway safety.
4) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
5) The all-weather pitch hereby consented shall not be used except between 09:00 hours and 22:00 hours (Monday to Friday (excluding public or bank holidays)) and 09:00 hours and 20:00 hours (Saturday, Sunday and public and bank holidays). All external floodlighting to the all-weather pitch hereby consented shall be automatically switched off at 22:15 hours (Monday to Friday (excluding public and bank holidays)) and 20:15 (Saturday, Sunday and public and bank holidays).

Reason: To protect the amenity of neighbouring residential occupiers
6) Before the use of the all-weather pitch hereby permitted commences a finalised Noise Management Plan, based on the draft Stratton Upper School Noise Management Plan by Surfacing Standards Limited, shall be submitted to and approved in writing by the Local Planning Authority. The Management Plan shall identify measures to control noise emanating from the hereby permitted facility and management responsibilities. All identified measures shall be implemented in accordance with the approved plan at all times unless otherwise agreed in writing by the Local Planning Authority beforehand.

Reason: To protect the amenity of neighbouring residential occupiers
7) No music nor amplified voices shall be emitted by the development at any time unless otherwise agreed beforehand, in writing, with the Local Planning Authority.

8) Use of the all-weather pitch hereby permitted shall not commence until a community use agreement, prepared in consultation with Sport England has been submitted to and approved in writing by the Local Planning Authority, and a copy of the completed, approved agreement has been provided to the Local Planning Authority. The agreement shall apply to the all-weather pitch and shall include details of pricing policy, hours of use, access by non-educational establishment users, management responsibilities and a mechanism for review. The development shall not be used otherwise than in strict compliance with the approved agreement.

Reason: To secure well managed safe community access to the sports facility/facilities, to ensure sufficient benefit to the development of sport and to accord with Policy HQ3 of the Central Bedfordshire Local Plan (2021).
9) Before the use of the all-weather pitch hereby permitted commences an updated site-wide Travel Plan for both school pupils and community users shall be prepared, submitted to and approved by the Local Planning Authority. The updated Plan shall contain:


Details on community use; opening/closing times and session times
Details of management responsibilities for the car park, outside of school hours
Details of how community users can access travel information, with a clear link provided on the school website referencing all sustainable travel modes available (bus routes & timetables, walking/cycling routes, location of cycle parking)

All measures agreed therein shall be undertaken in accordance with the approved Plan. There shall be an annual review of the Travel Plan (for a period of 5 years from the date of approval) to monitor progress in meeting the targets for reducing car journeys generated by the proposal and this shall be submitted to and approved by the Local Planning Authority.

Reason: In the interests of highway safety, to reduce congestion and to promote the use of sustainable modes of transport.
10) The surface water drainage shall be constructed to manage surface water runoff from the development for up to and including 1 in 100-year event (+40%CC), via attenuated discharge to the existing system. The final detailed design shall be based on the agreed Drainage Strategy (Ref: SSL, SIS025, 15/11/2022) and DEFRAs Non-statutory technical standards for sustainable drainage systems (March 2018) and shall be implemented and maintained as approved. Maintenance will ensure the system functions as designed for the lifetime of the development. Any variation to the connections and controls indicated on the approved drawing which may be necessary at the time of construction would require the resubmission of those details to the Local Planning Authority for approval.

Reason; To ensure the approved system will function to a satisfactory minimum standard of operation and maintenance and prevent the increased risk of flooding both on and off site, in accordance with CBC Local policy CC3 to CC5 and NPPF Paras 159 to 169 (inclusive of foot notes 54 to 56 and its supporting technical guidance).
11) Prior to the facility hereby permitted coming into first use, a scheme for additional tree and shrub planting along the western boundary of the site adjoining Orchard Close, shall be submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented by the end of the full planting season immediately following the completion and first use of the all-weather pitch facility (a full planting season means the period from October to March). The trees and shrubs shall subsequently be maintained for a period of 5-years and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To mitigate the visual impact of the proposed development upon the adjoining occupiers in Orchard Close.
