Conditions or Reasons for Planning Application - CB/22/04646/VOC
Conditions or Reasons:
1) The materials to be used for the external walls, roofs, soffits, fascias, rainwater goods and windows of the development hereby approved shall be implemented in full accordance with details shown on approved drawings ref: PL20/ rev G; PL/21/ rev E and PL22/ rev C (as approved under CB/21/05388/VOC), unless otherwise agreed in writing with the Local Planning Authority.

Reason: To control the appearance of the building in the interests of the visual amenities of the locality.

2) Before the premises are occupied, all on-site vehicular areas shall be surfaced in stable and durable materials in accordance with details to be approved in writing by the Local Planning Authority. Arrangements shall be made for surface water drainage from the site to soak away within the site so that it does not discharge into the highway or into the main drainage system.

Reason

To avoid the carriage of mud and other extraneous material or surface water from the site so as to safeguard the interest of highway safety and reduce the risk of flooding and to minimise inconvenience to users of the premises and ensure satisfactory parking of vehicles outside highway limits (policy T2, Central Bedfordshire Local Plan).
3) Prior to first occupation of the dwellings hereby approved, the visitor parking space shown on approved drawing PL03/rev Q shall be demarcated as such and shall be permanently retained thereafter.

Reason

For the avoidance of doubt and to ensure adequate parking provision within the development hereby approved (policy T3, Central Bedfordshire Local Plan).
4) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015, or any amendments thereto, the garage accommodation on the site shall not be used for any purpose, other than as garage accommodation, unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason

To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users (policy T3, Central Bedfordshire Local Plan).
5) Prior to first occupation, the proposed development shall be carried out and completed in all respects, in accordance with the access, siting and layout, turning area, and landscaping buffer, illustrated on the approved drawing ref: PL03/ rev Q and defined by this permission and, notwithstanding the provision of the Town and Country Planning (General Permitted Development) Order 2015 (any Order amending, revoking or re-enacting that Order), there shall be no variation without the prior approval of the Local Planning Authority. The landscaping buffer shall for the perpetuity of the development remain free of any obstruction to visibility.

Reason

To ensure that the development of the site is completed insofar as its various parts are interrelated and dependent one upon another and to provide adequate and appropriate access arrangements at all times and to provide adequate intervisibility between traffic within the site (policy T3, Central Bedfordshire Local Plan).
6) The boundary treatment approved under CB/22/00216/DOC shall be completed in accordance with the approved scheme before the buildings hereby approved are occupied and be thereafter retained.

Reason: To safeguard the appearance of the completed development and the visual amenities of the locality.

7) The bin collection area as shown on drawing ref: PL/03/ rev Q shall be surfaced and made available for use prior to the first occupation of the application site. The approved bin storage area shall be retained thereafter.

Reason

In the interest of the amenity of the area (Section 12, NPPF, 2021).
8) No occupation of any permitted building shall take place until the following has been submitted to and approved in writing by the Local Planning Authority:

A Validation Report by means of which the effectiveness of the remediation implemented by any Remediation Method Statement shall be demonstrated to the Local Planning Authority (to incorporate photographs and depth measurements).

Any unexpected contamination discovered during works should be brought to the attention of the Planning Authority.

Reason

To protect human health and the environment in accordance with Section 15 of the NPPF (2021)
9) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (including any Order amending, revoking or re-enacting that Order, with or without modification), no alterations or extensions to Plot 01 hereby approved, including the roof, nor any outbuildings (under Classes A, B, C and E) shall be carried out without the grant of a further specific planning permission from the Local Planning Authority.

Reason

Exceptional circumstances are considered in this case requiring restriction of permitted development rights to protect the privacy of the occupiers of adjoining properties

10) The first floor windows in the eastern and western elevations of plots 02 and 03 of the development hereby permitted shall be permanently fitted with obscured glass of a type to substantially restrict vision through them at all times and shall be non-opening, unless the parts of the windows which can be opened are more than 1.7m above the floor of the rooms in which the windows are installed. Notwithstanding the provisions of the Town and Country Planning (General Permitted Order) 2015 (or any Order amending, revoking or re-enacting that Order, with or without modification), no additional windows shall be inserted into the western flank elevations of Plots 02 and 03 facing 14, 16 and 19 The Sidings.

Reason

To protect the privacy of neighbouring residents (Section 12, NPPF, 2021).
11) The development shall take place in full accordance with details of the existing and final ground and slab levels of the buildings as shown on approved drawing ref: PL30/ rev B.

Reason

To ensure that an acceptable relationship results between the new development and adjacent buildings and public areas (Section 12, NPPF, 2021)
12) The development hereby approved shall be carried out in accordance with all ecological measures and/ or works as detailed in the "Preliminary Ecological Assessment including a Protected Species Scoping Assessment at Land South of The Sidings, Henlow Camp, Bedfordshire November 2017" , as submitted with CB/19/02693/FULL.

Reason

In the interest of the protection of the existing wildlife habitats on the application site, in accordance with advice in Section 15 of the NPPF (2021) and policy EE2 of the Central Bedfordshire Local Plan (2021).
13) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
14) The development shall be implemented in full accordance with the submitted landscaping scheme as shown on drawing ref: PL04/rev A (as approved under CB/21/05388/VOC). The approved scheme shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping.

15) Prior to first occupation of the dwellings hereby approved, details of the location of the proposed fire hydrant within the site as shown on approved drawing PL03/ rev N shall be submitted to and approved in writing by the Local Planning Authority. The fire hydrant serving that development shall be installed as approved. Thereafter, the fire hydrant shall be retained as approved in perpetuity.

Reason: In the interests of fire safety and providing safe and accessible developments.

16) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
17) The dormer window in the southern elevation of plot 1 hereby permitted shall be permanently fitted with obscured glass of a type to substantially restrict vision through it at all times and shall be non-opening, unless the parts of the window which can be opened are more than 1.7m above the floor of the room in which the window is installed. The rooflights hereby approved in plot 1 shall be a minimum of 1.7 metres above finished floor level of the rooms which they serve. No further windows or other openings shall be formed in plot 1.

Reason: To safeguard the privacy of occupiers of adjoining properties

18) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers PL20/ rev I; PL21/ rev E; PL22/ rev C; PL04/ rev C; PL03/ rev Q; PL30/ rev B

Reason: To identify the approved plan/s and to avoid doubt.
