Conditions or Reasons for Planning Application - CB/22/04935/VOC
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of the principal planning permission, which was approved 02 August 2021.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development hereby approved shall be carried out in complete accordance with the details and proposed mitigation included within the Noise Assessment, which was submitted and approved through CB/22/01583/DOC, dated 5th April 2022, as well as the temporary lighting plan dated April 2022.

Reason: To protect the amenity of nearby residential receptors.

3) The planting and landscaping scheme shown on approved Drawing No. 17734-LD-04 Rev E shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season shall mean the period from October to March). The planting and landscaping shall subsequently be maintained in accordance with the contents of the approved Landscape Management Plan (17734 V4.2, dated December 2022) for a period of ten years from the date of planting and any which die or are destroyed during this period shall be replaced during the next planting season with others of a similar size and species.

Reason: To ensure an acceptable standard of landscaping.

4) The development hereby approved shall be carried out in exact accordance with the plans submitted which secure the amendments and enhancements to the Public Right of Way network, shown on plan Nos. 2551-MHB-PLA-PO-0001 Rev P09 and 2551-MHB-DRG-PLA-0001 Rev P07. The proposed upgrades to the Rights of Way Network shall be fully implemented prior to the development being brought into use.

Reasons: In the interests of the amenity of pedestrians and other non motorised users and to ensure safety of users is not compromised by the traffic associated with the development.

5) The development hereby approved shall be carried out in exact accordance with the Construction Traffic Management Plan (Version 10, dated 20th December 2022), throughout the entire construction period.

Reason: In the interest of Highway Safety
(Policy T2 of the CBLP, and Section 9, NPPF)
6) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
7) The development shall not be bought into use until a scheme of public art to be incorporated into the proposed development has been submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented and retained as such prior to the footbridge being brought into use.

Reason: To ensure a high quality provision of public realm is secured for the users of the proposed development.

8) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers:
