Conditions or Reasons for Planning Application - CB/23/00465/FULL
Conditions or Reasons:
1) The proposal has failed to demonstrate that appropriate junction visibility could be achieved, and that the appropriate visibility could be secured without relying on land that the applicant does not control. It has not therefore been demonstrated that the proposed development could be served by a safe and suitable access. The proposed development is therefore in conflict with policy T2 of the Central Bedfordshire Local Plan (2021) and section 9 of the NPPF (2021).
2) The proposal has failed to demonstrate that the proposed access, which would meet Chaul End Road at an acute angle, could safely and conveniently accommodate all vehicle types likely to regularly need to take access. The proposed development is therefore in conflict with policy T2 of the Central Bedfordshire Local Plan (2021) and section 9 of the NPPF (2021).
3) Insufficient information has been provided within the application to demonstrate that the proposal would not have an unacceptable impact on protected species, habitats or ecosystems. As such, the proposal is contrary to policy EE3 of the Central Bedfordshire Local Plan (2021) and Section 15 of the NPPF (2021).
4) The Council considers that the proposed development would, by reason of its proximity lying within a 12.6km distance of the Ashridge Commons and Woods Site of Special Scientific Interest (SSSI) within the Chilterns Beechwoods Special Area of Conservation (SAC), add to the recreational disturbance in this area, and be likely to harm the integrity of the conservation purposes of the SAC. In the absence of an appropriate strategy to mitigate this harm, the proposal would be contrary to the Habitat Regulations, Section 15 of the NPPF (2021), and Policy EE3 of the Central Bedfordshire Local Plan (2021).
